Wholesale Service. Nothing in Section 8.2 and/or Section 8.3 of this Agreement, shall prohibit Subscribers classified as “Wholesale” customers from redistributing or reselling any Services authorized under the terms of Subscriber’s Wholesale Agreement. However, Subscribers who wish to be classified as Wholesale customers by OlyPen, must obtain a Wholesale Service Agreement from OlyPen.

Wholesale Service. When an appli- cant provides wholesale sales or serv- ices on a contract basis to another sys- tem or entity, similar wholesale sys- tem cost will be used in determining the amount of grant needed to achieve a reasonable wholesale user cost.

Wholesale Service. In order to secure the currently anticipated ultimate needs of the Project, the parties recognize and agree that it will be necessary for the Municipality to obtain both interim and permanent treated water service from the NTMWD by means of participation in the Xxxxxx-Xxxxxxx Alliance Project or by means of an alternative water supply and transmission agreement. It is currently contemplated that the construction of an offsite water transmission line and other related improvements including a pump station, ground storage tank, and elevated storage tank may be required. The Owner and Municipality agree to reasonably cooperate to establish the size and alignment of the offsite water transmission line, as well as, identify, size, and locate the other functionally related and necessary improvements. The offsite transmission line and related improvements shall be sized to serve not only the Project, but also certain areas within the Municipality as mutually agreed. The Parties agree to reasonably cooperate in the securing of a contract with NTMWD or an alternative source mutually agreeable to the Parties to secure treated water service in amounts and at times currently anticipated to be necessary to meet the needs of the Project, and to finance the necessary offsite transportation lines and related improvements. It is acknowledged and agreed that pursuant to the Utility Infrastructure Agreement, the Districts shall construct such offsite water transmission line and related improvements and convey them to the Municipality subject to the allocation of water supply capacity to the Property.

  • Verizon Retail Telecommunications Service Any Telecommunications Service that Verizon provides at retail to subscribers that are not Telecommunications Carriers. The term “Verizon Retail Telecommunications Service” does not include any Exchange Access service (as defined in Section 3(16) of the Act, 47 U.S.C. § 153(16)) provided by Verizon.

  • Mobile Services Your use of the Send Money Service may include access to some products and services through a mobile device ("Mobile Services"). By using the Mobile Services, you agree to the following terms. You agree that we may send you information relative to Mobile Services through your communication service provider and that your communication service provider is acting as your agent in this capacity. You agree to provide a valid phone number, e-mail address, or other delivery location so that we may send you information related to the Mobile Services. Additionally, you agree to indemnify, defend, and hold us harmless from and against any and all claims, losses, liability, costs, and expenses (including reasonable attorneys' fees) arising from your provision of a phone number, e-mail address, or other delivery location that is not your own or your violation of applicable federal, state, or local law, regulation, or ordinance. Your obligation under this paragraph shall survive termination of this Agreement. The Mobile Services are provided for your convenience and do not replace your account statement(s), which are the official record of your accounts. You understand and agree that these Mobile Services may not be encrypted and may include personal or confidential information about you such as your account activity or status. Delivery and receipt of information, including instructions for payment, transfer, and other money movement transactions through the Mobile Services may be delayed or impacted by factor(s) pertaining to your Internet service provider(s), phone carriers, other parties, or because of other reasons outside of our control. We will not be liable for losses or damages arising from any disclosure of account information to third parties, non-delivery, delayed delivery, misdirected delivery or mishandling of, or inaccurate content in, information and instructions sent through the Mobile Services. Additionally, not all of the products, services, or functionality described on the Site(s) and the Agreement are available when you use a mobile device. Therefore, you may not be eligible to use all the products, services or functionality described when you access or try to access them using a mobile device. We reserve the right to determine your eligibility for any product, service, or functionality. Information available via the Mobile Services, including balance, transfer, and payment information, may differ from the information that is available directly through the CCCU online services and Site(s) without the use of a mobile device. Information available directly through the CCCU online services and Site(s) without the use of a mobile device may not be available via the Mobile Services, may be described using different terminology (including capitalized terms used in the Agreement or on our Site(s), or may be more current than the information available via the Mobile Services, including but not limited to account balance information. The method of entering instructions via the Mobile Services may also differ from the method of entering instructions directly through the Service without the use of a mobile device. Processing of payment and transfer instructions may take longer through the Mobile Services. We are not responsible for such differences, whether or not attributable to your use of the Mobile Services. Additionally, you agree that neither our service providers nor we will be liable for any errors or delays in the content, or for any actions taken in reliance thereon. You are responsible for any and all charges, including, but not limited to, fees associated with text messaging imposed by your communications service provider.

  • Food Service If the Charter School offers food services on its own or through a third-party contract, the Charter School may apply directly to, and if approved, operate school nutrition programs with reimbursement from the United States Department of Agriculture, under supervision of the Tennessee Department of Education.

  • Conversion of Wholesale Services to Network Elements or Network Elements to Wholesale Services Upon request, BellSouth shall convert a wholesale service, or group of wholesale services, to the equivalent Network Element or Combination that is available to Think 12 pursuant to Section 251 of the Act and under this Agreement or convert a Network Element or Combination that is available to Think 12 pursuant to Section 251 of the Act and under this Agreement to an equivalent wholesale service or group of wholesale services offered by BellSouth (collectively “Conversion”). BellSouth shall charge the applicable nonrecurring switch-as-is rates for Conversions to specific Network Elements or Combinations found in Exhibit A. BellSouth shall also charge the same nonrecurring switch-as-is rates when converting from Network Elements or Combinations. Any rate change resulting from the Conversion will be effective as of the next billing cycle following BellSouth’s receipt of a complete and accurate Conversion request from Think 12. A Conversion shall be considered termination for purposes of any volume and/or term commitments and/or grandfathered status between Think 12 and BellSouth. Any change from a wholesale service/group of wholesale services to a Network Element/Combination, or from a Network Element/Combination to a wholesale service/group of wholesale services, that requires a physical rearrangement will not be considered to be a Conversion for purposes of this Agreement. BellSouth will not require physical rearrangements if the Conversion can be completed through record changes only. Orders for Conversions will be handled in accordance with the guidelines set forth in the Ordering Guidelines and Processes and CLEC Information Packages as referenced in Sections 1.13.1 and 1.13.2 below.

  • Eligible Services Subject to the sub-section titled ‘Restrictions’, only the following items provided by SAP (and/or SAP entities listed under “SAP entities in scope“ in the Order Form) can be ordered by the Customer (and/or Customer entities listed under “Customer entities in scope” in the Order Form) and counted in the calculation of expenditure against the Commitment Value:
