Common use of WITNESS DUTY LEAVE Clause in Contracts

WITNESS DUTY LEAVE. 1. Teachers served with a valid subpoena issued by a federal, state, county, or municipal court, or a federal or state legislative body, may be absent from duty, without loss of pay or other benefits, provided the teacher has: a) advised the immediate supervisor on the first school day following the receipt of the subpoena; and b) submitted a copy of the subpoena at the time the request for absence is made on the proper District form; and c) endorsed the witness duty payment, if the teacher has been paid for serving as a witness, excluding reimbursement for travel, meals, and lodging, over to the District within sixty (60) calendar days from the last day on which the witness duty was served. 2. Failure to deliver the endorsed fee payment to the District within this time period shall result in the loss of wages for the period of absence.
