Xxxxxx and Release of Liability. My participation in the Event is voluntary and subjects me to the possibility of physical injury (which could be minimal, serious, or result in death) and loss of or damage to my property (collectively known as the RISKS). Accordingly, I agree to the following:
(a) I hereby release and hold harmless Frankenmuth Rotary, its officers, directors, affiliated clubs, sponsors, employees, agents, volunteers, and contractors from any claim, demand, loss, liability, damage, and attorney’s fees and costs whatsoever arising from, related to, or resulting from these risks, including those caused by the negligent acts or omissions of any of those individuals that have been released.
(b) Furthermore, I agree to defend and pay the costs to defend those individuals who are released from any claim, demand, loss, liability, damage, and attorney’s fees even if it was caused by the negligent actions or omissions of those individuals I am releasing, holding harmless, and defending.
(c) I recognize the physical exertion involved in the event and state that I am physically fit to compete safely, and I have not been advised otherwise by a health care professional. Therefore, I fully assume the risks associated with such participation.
(d) I agree to accept responsibility for the conditions at the time of the event and the conditions and adequacy of my equipment.
(e) As between each of those individuals I have released and myself, I will be solely responsible for any and all medical and related bills that I may incur because of any injury, as well as costs related to loss or damage to my property, that I may sustain as a result of my participation in the Event, including those sustained on the premises where the Event is conducted and while I am traveling to and from such premises, regardless of the location or mode of transportation.
(f) This Agreement shall be binding on my estate, heirs, personal representatives, administrators, successors, and assigns, as well as any other party asserting a claim on my behalf or on behalf of my estate.

Xxxxxx and Release of Liability. I, for myself and my heirs, personal representatives, and assigns, do hereby covenant not to sue, release, waive, and discharge, from liability from any and all claims, including the negligence of CNPS, resulting in personal injury, accidents, or illnesses (including death), and property loss, arising from or related to my participation in the Activities. I acknowledge, agree, and understand that the foregoing waiver and release shall include claims for bodily injury, death, or property damage arising out of or related to my participation in the Activities, travel to and from the place of any Activities, and all Activities conducted at any premises occupied, owned, or operated by CNPS.

By initialing this section and signing this WAIVER below, YOU ARE AGREEING TO KNOWINGLY, VOLUNTARILY, AND UNEQUIVICALLY WAIVE ANY AND ALL CLAIMS, INCLUDING ACTIVE OR PASSIVE NEGLIGENCE BUT EXCLUDING GROSS NEGLIGENCE OR INTENTIONAL MISCONDUCT, against the Released arising out of any act, omission, or condition existing prior to the signing of the agreement, and extending to any act, omission, or condition in any way connected with your participation in (including transit to and from) these water sports activities occurring at any point in the future. THIS WAIVER AND RELEASE OF LIABILITY IS EXPRESSLY PROVIDED TO EXCULPATE THE RELEASED FROM THOSE LIABILITIES WHICH ARE SEPARATE FROM AND IN ADDITION TO THE POTENTIAL LIABILITIES CREATED BY THE RISKS INHERENT IN WATER SPORTS PARTICIPATION. Xxxxxx and Release of Liability. By registering for this Event and as a condition of participation in this event, each Competitor agrees to accept the terms and conditions of the MBBC Waiver and Release of Liability Agreement attached hereto below:
Xxxxxx and Release of Liability. By use of its facilities, grounds and equipment the Booking Party/Individual shall indemnify and save Wolf Creek Community Church harmless from any and all claims or liabilities which may arise as a result of use of the facilities, equipment and grounds of Wolf Creek Community Church for the activity or event undertaken by the Booking Party/Individual.
