Xxxxxxx’x Presence During Discipline & Procedure. (a) When the Company deems it necessary to discipline an employee they shall have the Union Xxxxxxx present. The Union Xxxxxxx shall be the one who is chosen by the employee and is present in the plant. The Grievor will be entitled to a co-worker of their choice as a witness during the absence of a Shop Xxxxxxx. If the employee or employees concerned feel they have been unjustly dealt with, they shall grieve within two (2) working days. In the case of suspension or dismissal the Union Xxxxxxx and Chief Xxxxxxx or his/her designated representative shall be present. In the case of dismissal, the procedure shall be as in Section 11.04 (b).
(b) If an employee is dismissed for any reason whatsoever and feels he or she has been unjustly dealt with he/she shall within two (2) working days from receipt of notice of dismissal, notify the Grievance Committee who shall within one (1) working day notify the Company in writing. The dismissal shall then constitute a grievance and shall be dealt according to the Grievance Procedure beginning with the "Second Step." If subsequently it is decided that the employee was unjustly dismissed, he or she shall be reinstated in his/her former position and shall be paid for this period during which he/she has not worked as if he/she had not been dismissed, or granted such lesser compensation as seems fair under the circumstances.
Xxxxxxx’x Presence During Discipline & Procedure. When the Employer deems it necessary to discipline an employee or interview an employee for disciplinary purposes, they shall advise the employee that they shall have a Union Xxxxxxx present. The Union Xxxxxxx shall be one who is chosen by the employee and would otherwise be present in the building at the time of the meeting. Wherever reasonably possible, the Employer will provide advance notice of the meeting, provided this does not cause undue delay of appropriate action. If the employee or employees concerned feel they have been unjustly dealt with, they shall grieve within five (5) working days. In the case of suspension or dismissal, the Union Xxxxxxx shall be present. In the case of a disciplinary meeting or investigation involving the Union Xxxxxxx, a Union Representative shall be present. This provision does not apply to those discussions that are of an operational nature and do not involve disciplinary action.
