Zoning of the Site. 8. The State shall ensure after consultation with the Local Authority that the Site shall be and remain zoned for use or otherwise protected during the currency of this Agreement so that the use to which the Trustee and any person claiming through or under the Trustee may put the Site in accordance with the provisions of this Agreement, and the erection and use of the Resort Complex thereon, may be undertaken and carried out without any interference or interruption by the State or by any agency or instrumentality of the State or by any local or other authority of the State on the grounds that such use is contrary to any town planning scheme or zoning by-law of the Local Authority or any other statutory town planning engineering or environmental provision. Zoning of the Site. The Zoning of the Site at the time of conveyance of the interest therein, shall be such as to permit development of the Site and construction of improvements thereon in accordance with the provisions of this Agreement including but not limited to the Scope of Development, and the use, operation and maintenance of such improvements. The Agency agrees to provide all proper assistance and cooperation to the Redeveloper to obtain all zoning, land use and other approvals so as to enable Redeveloper to meet requirements by the City of Hawaiian Gardens.
Zoning of the Site. It shall be the Developer’s responsibility at its sole cost and expense, to ensure that the zoning of each Subarea shall be such as to permit the development and use of that Subarea in accordance with the provisions of this Agreement. The Developer shall use every commercially reasonable effort to obtain any variances, conditional use permits or other discretionary or ministerial approvals needed to implement this Agreement. The Agency shall use reasonable and appropriate efforts to cooperate with the Developer in seeking any variances, conditional use permits or other discretionary or ministerial approvals needed to implement this Agreement, without liability to the Agency. If the Developer reasonably determines that the approved zoning or entitlement of a Subarea will substantially impede or render the development of that Subarea pursuant to this Agreement [Illegible] infeasible, the Developer may [Illegible] to the Agency for approval Site Modifications for that Subarea.

  • Underground Tanks If underground or other storage tanks storing Hazardous Materials located on the Premises or the Project are used by Tenant or are hereafter placed on the Premises or the Project by Tenant, Tenant shall install, use, monitor, operate, maintain, upgrade and manage such storage tanks, maintain appropriate records, obtain and maintain appropriate insurance, implement reporting procedures, properly close any underground storage tanks, and take or cause to be taken all other actions necessary or required under applicable state and federal Legal Requirements, as such now exists or may hereafter be adopted or amended in connection with the installation, use, maintenance, management, operation, upgrading and closure of such storage tanks.

  • Certificate of Occupancy; Licenses All certifications, permits, franchises, licenses, consents, authorizations, and approvals, including, certificates of completion and occupancy permits, required for the legal use, occupancy and operation of the Property have been obtained and are in full force and effect. The use being made of the Property is in conformity with the certificate of occupancy issued for the Property.

  • Floor Loading Floor loading capacity shall be within building design capacity. Tenant may exceed floor loading capacity with Landlord’s consent, at Landlord’s sole discretion and must, at Tenant’s sole cost and expense, reinforce the floor as required for such excess loading.

  • Excavation If any excavation shall be made upon land adjacent to or under the Building, or shall be authorized to be made, Tenant shall afford to the person causing or authorized to cause such excavation, license to enter the Premises for the purpose of performing such work as said person shall deem necessary or desirable to preserve and protect the Building from injury or damage and to support the same by proper foundations, without any claim for damages or liability against Landlord and without reducing or otherwise affecting Tenant’s obligations under this Lease.
