Scope of Development. Developer shall construct the Project in conformance with the Scope of Development, the 2022 SEIR Mitigation Measures, the 2022 SEIR Project Design Features, the Conditions of Approval, and substantially consistent with the Development Plan and the final plans and specifications approved by City. Developer shall not make any Material Changes to the Development Plan provided to the City as of the Effective Date without the written consent of the Director or his or her designee. “Material Changes” for the purposes of this Section 4.2 include modifications to the Development Plan that (i) change the proposed uses analyzed in the 2022 SEIR for the Property, (ii) increase the total amount of light industrial square feet beyond that analyzed in the 2022 SEIR for the Property (iii) decrease the amount of retail and/or restaurant, open space, community amenity, and programed square footage proposed in the Xxxxxx Country Mart, as set forth in the Project Site Plan shown on Exhibit C, attached hereto, and/or (iv) increase building heights for any portion of the Project. Further, Developer shall not construct the Project in a manner which would not be substantially consistent with the Development Plan and in conformance with the 2022 SEIR Mitigation Measures, the 2022 SEIR Project Design Features, this Agreement or the Project Agreements, except upon obtaining any additional permits, orders, licenses or approvals required by the Existing Land Use Regulations, Existing Development Approvals and Applicable Future Rules and Future Development Approvals made applicable to the Project and/or the Developer Property consistent with the terms of this Agreement. Modifications to the Development Plan that do not constitute Material Changes as defined above are considered Minor Modifications to the Development Plan that shall be made and approved administratively as set forth in Section 7.5 below. In the event of any proposed changes to the final plans and specifications to the Project following the Effective Date, Developer shall immediately provide the City with any such changes, which changes shall be subject to the terms of this Section. In addition, as soon as is practicable after completion of Project construction, Developer shall submit to City as-built plans and specifications showing the Project as actually constructed.
Scope of Development. 8.1.1. The Grant Recipient undertakes to implement and complete the Development in accordance with the approvals from the various Appropriate Authorities subject to the Project Budget, Development Schedule, Applicable Legislation, the provisions of this Agreement and the Development Agreement.
Scope of Development. The City and Developer hereby acknowledge that the City of Flagstaff Development Review Staff approved, subject to conditions, the site plan and building elevations for the Project attached hereto as Exhibit “B” and incorporated by this reference (collectively the “Site Plan”). The Site Plan sets forth the basic land uses, intensity and density of such uses, relative height, bulk and size of buildings and structures proposed by Developer for development within the Property. The Site Plan sets forth required improvements and dedications for the Project. As depicted on the Site Plan, the overall maximum number of multi- family condominium units on the Property is 169 with a total of 299 bedrooms. Notwithstanding the foregoing, the City acknowledges that, while the Developer intends to develop the Project in general conformance with the Site Plan, in order to make the Project economically viable and otherwise feasible, Developer may request amendments to the Site Plan. The City shall process all submittals made by Developer in conformance with its minor site plan modification process, and nothing contained herein shall preclude the City from the exercise of its normal review process and requirements in connection with its approval of such submittals.
Scope of Development. The Developer shall construct and develop or cause to be constructed and developed, in substantial compliance with the times set forth in the Performance Schedule, all Improvements which the Developer is obligated to construct and develop with respect to the Project under this Agreement. The Developer shall construct all Improvements in accordance with all applicable laws and building and permitting codes.
Scope of Development. The Developer shall be responsible for arranging, managing, overseeing, coordinating and administering the total development subject to the terms and conditions provided in this Agreement. The Developer shall demolish the existing structures and construct and develop, or cause to be constructed and developed, all Improvements which the Developer is obligated to construct and develop in accordance with the Project, Project Plan, and Project Schedule, and subject to the conditions established in this Agreement.
Scope of Development. “Scope of Development” means the description of the Project and the manner in which it will be developed as set forth in Exhibit D.

Scope of Development. Subject to the Conditions to Closing and other terms of this Agreement, the Site shall be developed by Developer as provided in the Scope of Development and the plans and Entitlements and Permits approved by Agency and City pursuant to Section 702. Notwithstanding any other provision set forth in this Agreement to the contrary, in the event of any conflict between the narrative description of the Project in this Agreement (including the Scope of Development) and the approved plans and Entitlements and Permits, the approved plans, Entitlements and Permits shall govern.
Scope of Development. Developer agrees to develop the Property and construct a premier Healthcare, Research, and Business campus with support of R&D and Mixed Commercial as suggested by the Deer Springs District Livable Center Study, and other related legal uses (the “Improvements”), in accordance with the basic concept drawings submitted by Developer to the City (the “Concept Plans”) and any applications, plans, maps, agreements, documents, and other instruments or entitlements necessary or appropriate for the development of the Property in accordance with the Concept Plans (the “Project”), including, without limitation, to the extent deemed necessary or advisable by Developer, applicable grading and improvement plans, permits, utility assignment and assumption agreements, and commercial designs and floor plans. Upon receipt of all approvals required pursuant to the North Las Vegas Comprehensive Master Plan, Title 15, 16 and 17 of the North Las Vegas Municipal Code, all as in effect as of the Effective Date, all such plans, maps and other entitlements necessary or appropriate for the development of the Property in accordance with the Concept Plans, and any revisions to such entitlements made in a manner that is permitted by this Agreement, shall be deemed “Approved Plansfor the purpose of this Agreement.
Scope of Development. Tenant will initially improve the Property by constructing improvements necessary for the operation of a ski resort on the Property, the scope of which shall be determined by Tenant after approval of Landlord. Tenant shall deliver to Landlord a scope or plan of improvement for review by Landlord. Landlord shall review and approve or disapprove of the Tenant's proposal within 45 days of submission of same by Tenant to Landlord. Tenant shall perform all Improvements in compliance with all applicable laws. To the extent that Tenant commences any improvements, Tenant shall complete it with reasonable diligence and within a reasonable period. Tenant shall pay for all Improvements when and as required by the parties that perform such improvements. Tenant shall timely obtain and promptly deliver to Landlord all approvals and permits necessary or appropriate for any improvements. All Improvements that Tenant constructs on the Property shall become part of the Property.
