Common use of Insurance Coverage Clause in Contracts

Insurance Coverage. At Leipzig University doctoral candidates can enrol as students at Leipzig University and therefore become doctoral students. Doctoral students of Leipzig University may be covered with an accident insurance in case an accident happens. An accident is only covered under such an insurance policy if it takes place within the organizational responsibility of Leipzig University and if it occurs at a time when the doctoral student undertook research or other relevant work in connection with his*her doctoral thesis and only if the requirements of the insurer are met, which is subject to the decision by “Unfallkasse Sachsen”. Should the doctoral candidate refrain from enrolment at Leipzig University the doctoral candidate needs to seek insurance coverage against accidents by her-:himself. In general the doctoral student must provide any health care assistance at her:his own expense. Leipzig University requests all students being in possession of a health insurance valid for the whole time of studies at Leipzig University. Liability and accident insurances are highly recommended. No party shall be responsible to any other party for any indirect or consequential loss or similar damage such as, but not limited to, loss of profit, loss of revenue or loss of contracts, provided such damage was not caused by a wilful act or by a breach of confidentiality. Both Universities shall implement this Agreement in good faith. The parties to this Agreement shall settle all issues and disagreements as regards the interpretation and implementation of the agreement by negotiation between the supervisors and the coordinators. In the event of any dispute concerning this agreement the parties shall strive for an amicable settlement. Should an amicable settlement be impossible, the dispute and any other claims, arising out of or in connection with the Agreement, • shall be governed o Preferred: by German law. o Secondary option: by the national law as determined by Regulation (EC) No 593/2008 of the European Parliament and of the Council of 17 June 2008 on the law applicable to contractual obligations (Rome I Regulation) and by Regulation (EC) No 864/2007 of the European Parliament and of the Council of 11 July 2007on the law applicable to non-contractual obligations (Rome II Regulation). • will be resolved • Preferred: within German courts exclusively. • Secondary option: by the courts of the seat (of administration) or domicile or habitual residence of the defendant as the exclusive court responsible in the first instance. The agreement on jurisdiction is independent of the other terms of the contract. Notwithstanding the aforementioned provisions of the binational agreement on joint supervision of doctoral dissertations, any dispute regarding the procedure for the doctoral dissertation of each University shall be governed in accordance with the regulations of Leipzig University and University of XXX individually. XXX and Leipzig University agree, that it is the individual responsibility of each institution to protect personal data of the doctoral candidate processed within the Binational Agreement for the Joint-Supervision of Doctoral Dissertations. The parties to the agreement commit to the principles of data protection and confidentiality. Personal data of persons involved will exclusively be processed for execution of this agreement. The parties undertake to make personal data of the doctoral candidate accessible to persons only that are part of the doctoral proceedings as stated within the regulations and statutes of the respective institution. Access shall be granted to the extent required in each case and information must be held confidential. Similarly as to members of the respective involved commissions concerning the doctorate access to personal data might be permitted to members of the faculties/departments and of the University administration. Furthermore, if appointed as external reviewer for the written thesis and/or the defence or as invited expert guests, the appointed/invited persons shall be permitted as well. In the beginning of the proceedings or their duties for the doctorate the parties to the agreement will instruct the persons permitted to access personal data to comply with the GDPR or national data protection laws subject these persons are not legally bound through collective or individual agreements instructed to comply with data protection requirements already. Leipzig University informs the doctoral candidate in ANNEX I in accordance with Art. 12, 13 GDPR about the purpose, scope, legal basis and rights with regard to the processing of personal data.
