Restrictions on use. 12.1 Unless otherwise explicitly stated in writing by Axolabs, Customer acknowledges and understands that Goods are labelled “For Research Use Only” and Services are provided for Customer’s internal research use only. Customer shall not use any Goods or Services for any clinical or diagnostic procedures. 12.2 Unless otherwise explicitly stated in writing by Axolabs, no license or other rights to use the Goods or Services for commercial applications (including without limitation in commercial services) are granted to the Customer expressly, by implication or by estoppel. Spearate licenses may be available for purchase with respect to commercial applications. 12.3 Customer shall be solely responsible for ensuring that any Goods and Services supplied by Axolabs are in compliance with all applicable laws and regulations, and to obtain any necessary approvals and Intellectual Property Rights required for the Customer’s particular use. 12.4 The Customer shall not use Axolabs’ name in any way to imply endorsement or otherwise by Axolabs of the Customer Materials, or of any process, information, advice, product or service provided, marketed or sold by the Customer.l
Restrictions on use. 5.1 The user is prohibited from - Posting content in DataCross that threatens, coerces, harasses, insults or otherwise infringes on the privacy of other persons; - post content that is punishable by law; post content that is pornographic, glorifies violence or violates the protection of minors; advertise, offer or distribute content via DataCross; - to post content that is racist or xenophobic or that expresses radical political, religious or ideological views. Linking to such content, which causes such content to be displayed on DataCross, is also prohibited. 5.2 Furthermore, the user is prohibited from using DataCross in a way that damages or disables DataCross or impairs the use of DataCross by other users. The user is prohibited from gaining unauthorized access to any DataCross data, other user accounts, computer systems and networks connected to DataCross by means of hacking, targeted password searches or other means.
Restrictions on use. 4.1 The Genesis Charge Pass with IONITY Advantage Rate is for you, the customer, only and is non-transferable. Use of your Genesis Charge Pass is only permitted in conjunction with your all-electric Genesis vehicle. Charging vehicles from other manufacturers with your Genesis Charge Pass is prohibited. In the event of charging of other manufacturers' vehicles using the Genesis Charge Pass, Genesis reserves the right to prohibit you from future access to the IONITY Advantage Rate. 4.2 Genesis is entitled to verify once a year - either electronically, by telephone or by post - proof of your status as the first purchaser of your all-electric Genesis vehicle. This is to ensure that only Genesis customers who have themselves purchased a new Genesis vehicle qualify for the IONITY Subscription or IONITY Advantage Rate. In the event that the Genesis Charge Pass is transferred to a third party, Genesis reserves the right to prohibit your future access to the IONITY Advantage Rate.

For any other type of use the customer shall be solely responsible. With regard to a possible liability for third party industrial or intellectual property rights, express reference is made to Sec. 8.8 below.

  • Qualität und Dokumentation 1. Der Lieferant hat für seine Lieferungen die anerkannten Regeln der Technik, die Sicherheitsvorschriften und die vereinbarten technischen Daten einzuhalten. Änderungen des Xxxxxx Xxxxxxxxxx GmbH & Co. KG HRA 361077 | Registergericht Stuttgart Liefergegenstandes bedürfen der vorherigen schriftlichen Zustimmung des Bestellers. Für die Erstmusterprüfung wird auf die VDA-Schrift „Band 2 Sicherung der Qualität von Lieferungen Produktionsprozess und Produktfreigabe PPF“, hingewiesen. Unabhängig davon hat der Lieferant die Qualität der Liefergegenstände ständig zu überprüfen. Die Vertragspartner werden sich über die Möglichkeiten einer Qualitätsverbesserung gegenseitig informieren. 2. Sind Art und Umfang der Prüfungen sowie die Prüfmittel und - methoden zwischen dem Lieferanten und dem Besteller nicht fest vereinbart, ist der Besteller auf Verlangen des Lieferanten im Rahmen seiner Kenntnisse, Erfahrungen und Möglichkeiten bereit, die Prüfungen mit ihm zu erörtern, um den jeweils erforderlichen Stand der Prüftechnik zu ermitteln. Darüber hinaus wird der Besteller den Lieferanten auf Wunsch über die einschlägigen Sicherheitsvorschriften informieren. Für weitergehende Informationen zu Mess- und Prüfprozessen wird auf die VDA-Schrift „Band 5 Prüfprozesseignung, Eignung von Messsystemen, Mess- und Prüfprozessen, Erweiterte Mess- unsicherheit, Konformitätsbewertung“ hingewiesen. 3. Bei den in den technischen Unterlagen oder durch gesonderte Vereinbarung besonders, zum Beispiel mit "D", gekennzeichneten Merkmalen hat der Lieferant darüber hinaus in besonderen Aufzeichnungen festzuhalten, wann, in welcher Weise und durch wen die Liefergegenstände bezüglich der besonderen Merkmale geprüft worden sind und welche Resultate die geforderten Qualitätstests ergeben haben. Die Prüfungsunterlagen sind mindestens fünfzehn Jahre aufzubewahren und dem Besteller bei Bedarf vorzulegen. Vorlieferanten hat der Lieferant im Rahmen der gesetzlichen Möglichkeiten im gleichen Umfang zu verpflichten. Für die Dokumentation und Archivierung wird auf die VDA Schrift „Band 1 Dokumentation und Archivierung – Leitfaden zur Dokumentation und Archivierung von Qualitätsforderungen“ sowie auf die VDA-Schrift „Prozessbeschreibung besondere Merkmale (BM)“ hingewiesen. 4. Soweit Behörden, die für die Kraftfahrzeugsicherheit, Abgasbestimmungen o. ä. zuständig sind, zur Nachprüfung bestimmter Anforderungen Einblick in den Produktionsablauf und die Prüfungsunterlagen des Bestellers verlangen, erklärt sich der Lieferant auf Bitten des Bestellers bereit, ihnen in seinem Betrieb die gleichen Rechte einzuräumen und dabei jede zumutbare Unterstützung zu geben.

  • Erfüllungsort, Gerichtsstand und anwendbares Recht Sofern sich aus der Auftragsbestätigung nichts anderes ergibt, ist unser Geschäftssitz Erfüllungsort.

  • Erfüllungsort, Gerichtsstand und anzuwendendes Recht 1. Erfüllungsort für unsere Lieferungen ist bei Lieferung ab Werk das Lieferwerk, bei den übrigen Lieferungen unser Lager. Gerichtsstand ist nach unserer Xxxx der Sitz unserer Hauptniederlassung oder der Sitz des Käufers. 2. Für alle Rechtsbeziehungen zwischen uns und dem Käufer gilt in Ergänzung zu diesen Bedingungen das deutsche unvereinheitlichte Recht insbesondere des BGB/HGB. Die Bestimmungen des UNÜbereinkommens vom 11. April 1980 über Verträge über den internationalen Warenkauf finden keine Anwendung.

  • Definitions 2.1. Account – the personal user account created on the Website for each Customer who has concluded a Master Loan Agreement with Ferratum. 2.2. Calculator – a tool made available on the Website to enable the Customer to calculate the Loan Interest in relation to the desired Loan amount and repayment period. 2.3. Common Message Services – include SMS, E-Mail or similar commonly used electronic message services. 2.4. Creditor – see below 2.8 2.5. Customer – an Eligible Customer, who entered into a Master Loan Agreement with the Creditor, or has declared such intent. 2.6. Invoice – the document which contains the Loan amount, the date of application for the Loan, amount due in respect of each instalment and the instalment repayment dates, and any other fees and charges payable in terms of the Master Loan Agreement and which is considered, until the repayment of all amounts due thereunder, to form an integral part of the Loan Agreement. 2.11. Loan – each individual loan of Ferratum to a Customer received or applied for under the Master Loan Agreement which has been issued by Ferratum upon an application by the Customer for an amount which is not lower than fifty Euro (€50) and not higher than one thousand five hundred Euro (€1500) and which has a repayment period of no longer than sixty two (62) days. 2.12. Loan Application – the Customer's offer to enter into a Loan under a valid Master Loan Agreement with Ferratum, such offer following the form and procedure set forth by Ferratum. 2.13. Loan Interest – the interest payable by the Customer in respect of the Loan calculated as specified in Appendix 1. 2.14. Master Loan Agreement – a framework agreement between a Customer and Ferratum for an indefinite period which includes these Standard Terms, the 2.15.   • Liability of the Hotel 7.1 The hotel is liable for harm inflicted on life, limb and physical health. Further it is liable for other damage caused with full intent or gross negligence or due to inten- tional or grossly negligent violation of obligations typical for the contract. A breach of obligation of the hotel is deemed to be the equivalent to a breach of a statutory rep- resentative or vicarious agent. All other claims for damages are excluded, if not de- termined differently in this No. 7. Should disruptions or defects in the performance of the hotel occur, the hotel shall act to remedy such upon knowledge thereof or upon objection by the customer made without undue delay. The customer shall be obliged to undertake actions reasonable for him to eliminate the disruption and to keep any possible damage to a minimum. 7.2 The hotel is liable to the customer for property brought into the hotel in accordance with the statutory provisions. It recommends the use of the hotel or room safe. If the guest wishes to bring with him money, securities, stocks, bonds or valuables with a value of more than 800 EUR or other things with a value of more than 3500 EUR, a separate safekeeping agreement is necessary. 7.3 Insofar as a parking space is provided to the customer in the hotel garage or a hotel parking lot, this does not constitute a safekeeping agreement, even if a fee is ex- changed. The hotel only assumes liability for loss of or damage to motor vehicles parked or manoeuvred on the hotel’s property and the contents thereof only pursu- ant to the preceding No. 7.1, sentences 1 to 4. 7.4 Wake-up calls are carried out by the hotel with the greatest possible diligence. Messages, mail, and merchandise deliveries for guests shall be handled with care. The hotel will deliver, hold, and, for a fee, forward such items (on request). The ho- tel only assumes liability according to the preceding No. 7, sentences 1 to 4. 8.1 Amendments and supplements to the contract, the acceptance of offers or these general terms and conditions should be made in written form.
