Bound Party definition

Bound Party has the meaning set forth in Section 19(a) of this Agreement.
Bound Party means each of the following: the Declarant, each Builder, each contractor, subcontractor, supplier, and laborer, the Metropolitan District, to the extent permitted by law, and their respective directors, officers, members, partners, employees and agents; the ARC and the committees and representatives appointed by the ARC, the NCDRC, and each of their respective members and agents; all Persons subject to this Declaration; and any Person who is not otherwise subject to this Declaration, but who agrees to submit to this Article. Notwithstanding the foregoing, “Bound Party” shall not include any of the Persons identified in this Section, if such Persons have jointly entered into a separate written agreement providing for dispute resolution applicable to the Claim; in such circumstance, the dispute resolution mechanism set forth in such separate written agreement between such Persons shall apply with respect to such Claim, unless such Persons mutually agree to submit such Claim to the provisions of this Article.

Examples of Bound Party in a sentence

  • Each Bound Party shall present the mediator with a written summary of the Claim.

Bound Party has the meaning specified in Section 5.6(c).
Bound Party means each of the Persons subject to this Declaration and any Person not otherwise subject to this Declaration who agrees to submit to this Article10. Notwithstanding the foregoing, “Bound Party” does not include any of the parties identified in this subsection 10.1(b) if such parties have jointly entered into a separate written agreement providing for dispute resolution applicable to the Claim. In such circumstance, the dispute resolution mechanism set forth in such separate written agreement between such parties shall apply with respect to such Claim unless the parties mutually agree to submit such Claim to the provisions of this Article 10.
Bound Party means and refer to the Declarant, its officers, directors, members, managers, employees and agents, the Association, its officers, directors and committee members, managers, employees and agents, and any other person or entity not otherwise subject to this Declaration who agrees to submit to this Article 24.
Bound Party means any Institutional Party or Consumer Party who asserts a Claim or has a Claim asserted against such party.
Bound Party has the meaning set forth in Section 12(b).
Bound Party means any (i) Member, or (ii) former Member who is bound by certain provisions of this Agreement as provided in Section 4.5(d).
Bound Party means any and all current and future owners, developers, lessees (other than Residents), easement holders or licensees of all or any portion of or interest in the Property; and their respective heirs, executors, administrators, legal representatives, devisees, successors and assigns.
