This warranty is conditional upon the Seller receiving written notification of the malfunction within six (6) months from date of Certificate of Installation and Operation but in no event later than eight (8) months from the date of delivery pursuant to clause 3.1.
The Seller's obligations shall apply only to failures to meet the foregoing warranty occurring within six (6) months from date of Certificate of Installation and Operation but in no event later than eight (8) months from the date of delivery pursuant to clause 3.1. The Seller's sole obligation under this warranty shall be the repair or replacement, at the Seller's sole option, of defective equipment.
The results of the said tests shall be recorded in a Certificate of Installation and Operation and the system shall be deemed accepted by Purchaser when such certificate shall be signed by both parties, or when the Purchaser commences commercial use of the system, whichever is the first to occur.
Such test shall be over a duration mutually agreed upon by ICERS and VENDOR within limits of a minimum period of twenty (20) days and a maximum of sixty (60) days, per Phase, from the date a Certificate of Installation is issued, and extendible thereafter as set forth herein (the “Acceptance Period”).
The following form is to be use for procedurally conducting inspections and commissioning, and for documentation purposes: Certificate of Installation, Inspection and Start‐Up Services to be used to document completing operational testing, certification, and commissioning for each item of mechanical, electrical, and instrumentation equipment provided or installed under this Agreement.
