Declarant shall have the right, but not the obligation, to convey, transfer, sell or assign all or any portion of the Community Systems located within the Property, or all or any portion of the rights, duties or obligations with respect thereto to the Association or any other person or entity (including an Owner, as to any portion of a Community System located on/in such Owner’s Lot).
Subject to the terms of this Declaration, the Association, at its expense, shall be responsible for the operation, reasonable maintenance, repair and replacement of all of the Improvements and facilities located upon the Association Property (excluding public utilities and Community Systems, to the extent same have not been made Association Property).
Notwithstanding anything to the contrary in this Declaration, Declarant and its Affiliates, and its and their designees shall have a perpetual exclusive easement over, across, upon, through and under the Association Property and the Lots (but not under buildings on Association Property or Lots) for the installation, operation, maintenance, repair, replacement, alteration and expansion of Community Systems.
The Association’s rights with respect to the Community Systems and the services provided through such Community Systems are exclusive, and no other Person may provide such services through the Community Systems without the prior written consent of the Association.
The Contractor shall have 4 business days to complete what is constituted as a minor repair according to the manufacture.
The SWSMP will be organized per DOH requirements and will include the specific items noted in the Small Water System Management Program (SWSMP) Checklist for Community Systems that was completed during a pre-planning meeting with the City, DOH, and the Consultant in May 2020.
The Association and its designees shall have a perpetual easement over, upon, and under the Community and the portions thereof designated in plats for the installation, operation, maintenance, repair, replacement, alteration and expansion of Community Systems and other utilities.

The Owner of a Lot further agrees to pay for all utilities (including, without limitation, those provided by the Community Systems), such as telephone, cable or satellite television, telecommunication systems, home monitoring, water (including water associated with irrigation),sewer, sanitation, electric, etc., that may be separately billed or charged to each Home.
