Contingency Counsel definition

Contingency Counsel means Xxxxx Xxxxxx and any other counsel engaged by the Trust and/or the Liquidating Trustee on a contingency fee basis to pursue the Causes of Action, the Known Litigation Claims, and/or Avoidance Actions. The Trustee, in his/her sole discretion, may continue to use S&M Law as Contingency Counsel to pursue Avoidance Actions and Xxxxx & Xxxxx as Contingency Counsel to purse collection of accounts receivable following the Effective Date.

  • Certified counselor means an individual who is certified by a training program or certifying organization, approved by the director, that authenticates the competence of individuals who provide education and assistance to other individuals in connection with debt counseling and financial counseling functions.
