Customer Delay definition

Customer Delay has the meaning set forth in Section 4.1.
Customer Delay means any delay in meeting the standards set out in Annex C, for ordering, provisioning, delivery and fault repairs which is due wholly or partly to the Access Seeker or its Customers for whom the service is being performed.
Customer Delay means each day that Substantial Completion is delayed by any of the following:

Examples of Customer Delay in a sentence

  • If Customer requires extension of the Service Period as the result of a Customer Delay, such extension shall be subject to additional fees and expenses.

  • In all such circumstances, Xxxxxxxxx’s obligations will, to the extent so hindered by the Customer Delay, be permissibly delayed or excused.

  • If Customer fails to satisfy in a timely manner its responsibilities in any material respect (a "Customer Delay"), then any resulting delay or effect upon Relay HC’s performance under the Order Form shall be excused or extended for the amount of time caused by Customer Delay.

  • Notwithstanding anything herein to the contrary, if Customer fails to respond to Relay HC’s communications regarding an alleged Customer Delay, Relay HC may, in addition to any rights it may have, and at its option, suspend all work under an Order Form or terminate the Order Form.

  • If the deliverable(s) associated with a particular Key Milestone have not been achieved by the relevant date, the Contractor shall pay the Customer Delay Payments.

  • Customer Delay Any delay that is caused by the Other Licensed Operator not realising its responsibilities.

  • Notwithstanding anything herein to the contrary, if Customer fails to respond to Stemmons’ communications regarding an alleged Customer Delay, Stemmons may, in addition to any rights it may have, and at its option, suspend all work under an Order Form or terminate the Order Form.

  • In all such circumstances,Xxxxxxxxx’s obligations will, to the extent so hindered by the Customer Delay, be permissibly delayed or excused.

  • Subject to 5.1.4, if a Milestone has not been achieved by the relevant Milestone Date, the Supplier shall pay to the Customer Delay Payments in accordance with the table above for each day of delay from and including the relevant Milestone Date until and including the date on which the relevant Milestone criteria are actually Achieved and the Customer provides the Supplier with a Satisfaction Certificate (set out in Schedule 4).

Related to Customer Delay

  • Excusable Delay means a delay due to acts of God, governmental restrictions, stays, judgments, orders, decrees, enemy actions, civil commotion, fire, casualty, strikes, work stoppages, shortages of labor or materials or other causes beyond the reasonable control of Borrower, but lack of funds in and of itself shall not be deemed a cause beyond the control of Borrower.

  • Service Level Failure means a failure to perform the Software Support Services fully in compliance with the Support Service Level Requirements.

  • Customer Equipment means hardware, software, systems, cabling and facilities provided by you and used in conjunction with the Equipment that we supply to you in order to receive the Services;

  • Downtime means the Total Minutes in the Month during which the Cloud Service (or Servers for Server Provisioning) does not respond to a request from SAP’s Point of Demarcation for the data center providing the Cloud Service (or Server for Server Provisioning), excluding Excluded Downtime.

  • Customer Premises Equipment or "CPE" means equipment employed on the premises of a Person other than a Carrier to originate, route or terminate Telecommunications (e.g., a telephone, PBX, modem pool, etc.).

  • Force Majeure means an event beyond the control of the supplier and not involving the supplier’s fault or negligence and not foreseeable. Such events may include, but is not restricted to, acts of the purchaser in its sovereign capacity, wars or revolutions, fires, floods, epidemics, quarantine restrictions and freight embargoes.
