Defendant Released Parties definition

Defendant Released Parties means (a) Defendants and, as applicable, each of their predecessors, successors, current and former parents, subsidiaries, affiliates, divisions, related companies, assigns, descendants, dependents, beneficiaries, marital community, heirs, executors, and administrators; (b) each of the current and former officers, directors, trustees, and fiduciaries, committees, employees, investment consultants, administrators, actuaries, agents, insurers, representatives, attorneys, and retained experts of the entities and individuals in (a); and
Defendant Released Parties means any and all defendants named in any of the complaints filed in the Action and any and all of their related parties, including, without limitation, any and all of their past or present parents, subsidiaries, affiliates, predecessors, or successors, as well as any and all of its or their current or former officers, directors, employees, associates, members of their immediate families, agents or other persons acting on their behalf, underwriters, insurers, reinsurers, attorneys, advisors, financial advisors, publicists, independent certified public accountants, auditors, accountants, assigns, creditors, administrators, heirs, estates, or legal representatives.
Defendant Released Parties means Defendants, ANR, Defendants’ Counsel and each of their respective past or present subsidiaries, parents, affiliates, principals, successors and predecessors, assigns, officers, directors, shareholders, trustees, partners, agents, fiduciaries, contractors, employees, attorneys, auditors, insurers; the spouses, members of the immediate families, representatives, and heirs of the Individual Defendants, as well as any trust of which any Individual Defendant is the settlor or which is for the benefit of any of their immediate family members; any firm, trust, corporation, or entity in which any Defendant has a controlling interest; and any of the legal representatives, heirs, successors in interest or assigns of the Defendants.

  • The proposed Settlement will release all Settled Claims against each Defendant and the other Defendant Released Parties.

  • The Parties acknowledge that the execution of this Settlement Agreement and consummation of the transactions contemplated hereby do not constitute an admission of liability, wrongdoing, or of any facts by the Defendant Released Parties.

  • Upon the Effective Date, the Plaintiff Releasing Parties shall release and be deemed to release and forever discharge and shall be forever enjoined from prosecuting the Released Claims against the Newly Settling Defendant Released Parties, regardless of whether such Plaintiff Releasing Party executes and delivers a Proof of Claim and Release Form.The capitalized terms used in this paragraph are defined in the Third Settlement Agreement, Preliminary Approval Orders, or this Notice.

  • That means you cannot sue, continue to sue, assist a third-party in suing, or be part of any other lawsuit about the Released Claims in this Action against the Settling Defendant Released Parties.


More Definitions of Defendant Released Parties

Defendant Released Parties means the Depositary and its affiliates, officers, directors and employees.

Defendant Released Parties means the University of Chicago and its affiliates, the Trustees of the University and the University’s affiliates, and any and all current and former employees of the University and the University’s affiliates including those who have acted as a fiduciary or provided services to one of the Plans at any time during the class period.
