Effective Date of Class Settlement definition

Effective Date of Class Settlement means the date by when: (1) the Court’s Final Approval Order is a final, appealable judgment; and (2) either: (a) no appeal has been taken from the judgment relating to the merits of the settlement as of the date on which all times to appeal therefrom have expired, or (b) an appeal or other review proceeding of the judgment relating to the merits of the settlement having been commenced, such appeal or other review is finally concluded and no longer is subject to review by any court, whether by appeal, petitions for rehearing or re-argument, petitions for rehearing en banc, petitions for writ of certiorari, or otherwise, and such appeal or other review has been finally resolved in a manner that affirms the Final Approval Order in all material respects. If the Final Approval Order on Fees is entered separately or at a later date, this shall not impact the Effective Date of Class Settlement, but any obligation to pay Court-approved Class CounselsFees and Expenses shall arise only after the Effective Date of Fees Settlement.

Effective Date of Class Settlement means the day after the date on which any rights to appeal the trial court’s order granting final approval to the settlement expire or, in the event of an appeal, the date on which all appeals are finally decided or terminated.   • Effective Date of Settlement means: the date on which all of the conditions to settlement set forth in § 2 of this Settlement Agreement have been fully satisfied or waived and the Settlement shall have become Final.
