Nothing in this paragraph shall be construed to restrict Class Counsel's ability to communicate with Class Members in accordance with Class Counsel's ethical obligations owed to Class Members.
If this Settlement is approved by the Court, in conjunction with the Settlement Hearing, Class Counsel will request the Court to approve Class Counsel's application for attorneys' fees and expenses, not to exceed $250,000, in prosecuting this Action and securing a benefit for the members of the Class.
The Individual Notice shall list Class Counsel's addresses, telephone numbers and e-mail addresses.
A modification or reversal on appeal of any amount of Class Counsel's attorneys' fees and expenses awarded by the Court from the Settlement Fund or any Plan of Allocation of the Settlement Fund shall not be deemed a modification of all or a part of the terms of this Agreement or such final judgment.

Class Counsel's entitlement, if any, to an Attorneys' Fee Award and the Plaintiff’s entitlement, if any, to a Service Award, will be determined by the Court.
Except as provided herein, these sums are inclusive of payment for (a) all amounts paid to Class Members, including Named Plaintiffs, which are to be distributed pursuant to this Settlement Agreement; (b) all Class Counsel's attorneys' fees and costs as set forth in Section IV.A.2. above; and (c) applicable federal, state and local income taxes, and federal and state unemployment taxes required to be withheld and/or paid by Dell.
Following Final Approval, including the approval of Class Counsel's attorneys' fees and costs, and within thirty (30) days after the Effective Date, the Claims Administrator will pay Class Counsel the amount of One Million, One Hundred Thousand Dollars ($1,100,000) as attorneys' fees and costs, directly from the Settlement Fund.
If you are a member of the Class and do not request to be excluded, you can tell the Court you like the Settlement and it should be approved, or that you object to the Settlement or Class Counsel's requests for attorneys' fees, costs, and expenses and class representative Incentive Awards, if you do not like a part of the Settlement.
