Electric Rate definition

Electric Rate shall have the meaning set forth in Section 13.2 hereof.
Electric Rate will mean the Service Classification pursuant to which Tenant would purchase electricity directly from the utility company servicing the Premises, provided, however, at no time shall the amount payable by Tenant for electricity be less than Landlord’s cost, and provided further that in any event, the Electric Rate shall include all applicable surcharges, and demand, energy, losses, fuel adjustment and time of day charges (if any), taxes, and administrative and other sums payable in respect thereof.
Electric Rate means, at the time in question, the actual cost to Landlord of acquiring electricity for the Premises, including all surcharges, taxes, fuel adjustments, taxes regularly passed on to customers by the public utility, and other sums payable in respect thereof for the supply of electrical energy to Landlord for the entire Building.

More Definitions of Electric Rate

Electric Rate means one hundred and three percent (103%) of Landlord’s average cost per kilowatt hours for electricity for the Building (“Landlord’s Actual Cost”). The Landlord’s Actual Cost shall be computed by taking the Landlord’s total electrical xxxx including both consumption and demand charges, fuel adjustment charges (as determined for each month of the relevant period and not averaged), rate adjustment charges, sales tax, and/or any other factors or charges, actually used by the utility servicing the Building in computing the charges for Tenant’s usage (and inclusive of all discounts provided to the Building), divided by the total number of kilowatt hours. Tenant shall pay an amount equal to the product of (i) total number of kilowatt hours consumed by Tenant (excluding electricity consumed by any base Building systems (including, but not limited to, HVAC), multiplied by (ii) Landlord’s Actual Cost. Subject to the provisions of this Article 24, Landlord shall furnish electric energy to the Premises on a submetering basis for the purposes permitted under this Lease and Tenant shall purchase the same from Landlord at the Electric Rate as applied to the electric energy consumed in the Premises, which electric energy shall be measured by a submeter or submeters (which submeters and all supplemental equipment and all other necessary work necessary for the installation of the submeters shall, at Landlord’s cost, be installed prior to the applicable Term Commencement Date to the extent not already so installed and shall measure only Tenant’s electrical consumption) maintained by Landlord at Tenant’s expense. No base Building systems (including, but not limited to, HVAC) shall be included on Tenant’s submeter. Tenant shall have the right, from time to time, at Tenant’s sole expense, to check the accuracy of the aforesaid submeter or submeters by the use of check meters. Landlord shall not charge Tenant any fee for connection to the Building’s fire alarm system or central station monitoring.
Electric Rate means at the time in question 108% of the public utility rate schedule (including all surcharges, taxes, fuel adjustments, taxes regularly passed on to consumers by the public utility, and other sums payable in respect thereof) for the supply of electric energy to Landlord for the Building. Notwithstanding the foregoing provisions of this Section, if the public utility rate schedule (with such inclusions) applicable to Landlord for the purchase of electric energy for the Building shall be less than the public utility rate schedule applicable to Landlord, if Landlord were to purchase electricity solely for the Premises, then the higher rate schedule shall be used in determining the Electric Rate.
Electric Rate means the greater of either: (a) the Service Classification pursuant to which Landlord purchases electricity from the utility company servicing the Building, or (b) the Service Classification pursuant to which Tenant would purchase electricity directly from the utility company servicing the Building, provided, however, at no time shall the amount payable by Tenant for electricity be less than Landlord's Cost per Kilowatt and Cost per Kilowatt Hour (as such terms are hereinafter defined), and provided further that in any event, the Electric Rate shall include all applicable surcharges, and demand, energy, fuel adjustment and time of day charges (if any), taxes and other sums payable in respect thereof.
Electric Rate. (including all applicable surcharges, demand charges, energy charges, fuel adjustment charges, time of day charges, taxes and other sums payable in respect thereof) shall mean the greater of: (i) the electric rate determined by the service classification pursuant to which Owner purchases electricity from the utility company servicing the Building, and (ii) the electric rate determined by the service classification pursuant to which Tenant would purchase electricity directly from the utility company servicing the Building.
Electric Rate shall be deemed to mean the rate at which ------------- Sublessor purchases electrical energy from the public utility supplying electrical service to the Building, including any surcharges or charges incurred (except for interest or late fees) or taxes payable by Landlord in connection therewith and increased or decreased by reason of a fuel adjustment or any substitutions for such electrical rate or additions thereto. Electric Rate means the greater at the time in question of the public utility rate schedule (including all surcharges, demand charges, time of day charges, seasonal rate adjustment charges, taxes, fuel adjustments, taxes regularly passed on to consumers by the Utility Company, and other sums payable in respect thereof) for the supply of electric current (1) to Landlord for the entire Building, as if Landlord were to purchase current solely for the Demised Premises; or (2) to Tenant for the Demised Premises, as if Tenant were to purchase electric current solely for the Demised Premises. Notwithstanding the foregoing provisions of this Paragraph B, if the Utility Company rate schedule (with such inclusions) applicable to Landlord for the purchase of electric current for the entire Building shall be increased, and the percentage of the increase in such rate schedule shall exceed the percentage of the increase, if any, in the Utility Company rate schedule (with such inclusions) applicable to Landlord for the purchase of electric current solely for the Demised Premises, then the percentage of the increase in the cost to Landlord for the purchase of electric current for the entire Building shall be used in determining the Electric Rate.
Electric Rate means an amount equal to the actual cost to Landlord, including all applicable taxes, demand charges, fuel factors, transfer adjustment factors, or any other charges of the utility, of all electricity purchased for the Building plus five percent (5%) of the total amount thereof as an administrative charge to Landlord. Effective as of the Term Commencement Date, Tenant agrees to pay to Landlord or Landlord’s designated agent charges for electric current consumed by Tenant as determined by Landlord’s electric consultant in accordance with Section 24.03 below. Bills therefore computed using the Electric Rate shall be rendered at such times as Landlord may elect based upon estimates of Landlord’s electric consultant which may be made from time to time as Landlord deems necessary. Until such time as Landlord’s electrical consultant first makes its estimate as aforesaid, Tenant shall pay as its electricity charge hereunder the sum of $15,318.00 per annum (Base Charge) which shall be payable in equal monthly installments, together with the Tenant’s payments of Fixed Rent hereunder, on the first day of each calendar month. In the event Landlord’s consultant shall determine that Tenant’s electricity charge should exceed the Base Charge (due to an increase in either Electric Rate or Tenant’s consumption), Tenant’s electricity charge hereunder shall be adjusted retroactively at such time as Landlord’s electric consultant’s determination is made. Any deficiency for such prior period shall be payable upon demand. If, at any time after the date hereof, the Electric Rate shall be increased or decreased, then effective as of the date of such change, Tenant’s electricity charge hereunder shall be increased or decreased by the same percentage as that by which the Electric Rate is increased or decreased. In no event shall the electricity charge payable by Tenant hereunder be lower than the Base Charge. Tenant shall permit Landlord’s electric consultant to make surveys in the Premises (and Tenant shall cooperate with such consultant in providing any information required by the consultant) from time to time during normal business hours regarding the electrical equipment and fixtures and the use of electric current therein, but such consultant will endeavor to minimize the disruption of Tenant’s business.
