Exclusive Category shall include the following nonalcoholic beverages:

Exclusive Category means only healthcare providers/hospitals/medical facilities, as well as any medical institution and/or medical academic institution affiliated with any colleges, universities, or graduate schools. Category will not include health insurance companies.

• The exact beverage product mix within the Exclusive Category shall be designated by Sponsor and the place and date(s) of delivery of such VIK product shall be mutually agreed upon by Brooklyn Arena and Sponsor.

• In connection therewith, Sponsor acknowledges that the Entitlements granted hereby shall relate only to Sponsor’s products or services within the Exclusive Category and that Sponsor shall have no rights to Entitlements outside the Exclusive Category.

• In addition, Sponsor shall provide to NJ Basketball, on a VIK basis, $[***] worth of Sponsor’s beverage products (at Sponsor’s wholesale pricing) within the Exclusive Category (as defined below) in each year between the Commencement Date and the Team Occupancy Date.

• Brooklyn Arena agrees to discuss with Sponsor every six (6) months when requested by Sponsor (as of the Commencement Date) to determine whether the Beverage Mix Target should be adjusted based upon general consumer demand for beverages within the Exclusive Category.

• Further, Gannett Media agrees that it will not, without Tipico’s consent, engage with any “talent” who has an active sponsorship arrangement in the Exclusive Category in connection with any event that is within the GM Promotions or the focus of which is gambling or Fantasy Sports.

• StadCo and any such additional team shall have the right to grant rights, benefits, and privileges related to such additional team to another sponsor within the Exclusive Category with respect to any such additional team’s home games played at the Stadium.

• From the Effective Date through the end of the Term, and as long as no Sponsor Default exists, Entity hereby agrees that it shall not grant to any Direct Competitor any right or license to market or promote any products or services within the Exclusive Category anywhere at, or in conjunction with, the Events or the Spark!Fishers 5K.

Exclusive Category means online financial exchange platforms that interact with blockchain technology solely for users to purchase, deposit, stake or sell Cryptocurrency in exchange for other Cryptocurrency or conventional fiat money; provided, however, that, for the avoidance of doubt, the term “Exclusive Category” shall not include (i) any digital or virtual currency (e.g., Bitcoin, Ethereum, Ripple, etc.) (“Cryptocurrency”); (ii) any retail or commercial banking services, including, without limitation, retail and commercial banking and lending, saving and loans, personal and commercial loans, certificates of deposit, checking, savings and money market accounts, direct and online banking services or automated teller or banking machines or services, or payment processing services; (iii) any form of payment cards, including without limitation, any consumer or business credit cards, charge cards, ATM cards or debit cards; (iv) any foreign currency exchanges for any fiat money; (v) any online or digital wallet and/or wallet payment services or peer-to-peer payment services that run or process payment transactions via a payment processing network (e.g., PayPal/Venmo); (vi) any wealth management services, financial advisory services or retail brokerage services, including, without limitation, any trading platform for mutual funds, exchange-traded funds or money-market funds; (vii) any platform that enables or permits users to buy, sell or trade any physical products, non-fungible tokens or other digital assets or offerings that represent a unique tangible or intangible item, including, without limitation, any digital asset or offering that includes or depicts any content (e.g., TopShot, Nifty Gateway, etc.); or (viii) any other platform or application that utilizes or deploys any form of blockchain or other technology for any purpose other than to primarily facilitate the purchase or sale

Exclusive Category means those product and/or service categories identified on Exhibit A.

Exclusive Category means, with respect to the ▇▇▇▇▇ Half Marathon, Sparks!Fishers and the Spark!Fishers 5K, the grocery supercenter category. The Exclusive Category explicitly excludes any and all drug stores, convenience stores, pharmacies, gas stations, and sporting goods stores.

Exclusive Category has the meaning set forth in Section 4(b), subject to the exceptions and limitations set forth in Sections 4(c) and 4(d).
