Exterior Common Area definition

Exterior Common Area or “Exterior Common Areas” shall mean all areas, structures, parking areas, access driveways, roadways, sidewalks, plazas, landscaped areas, traffic lights, storm drainage facilities, sanitary sewer, domestic and fire water systems, fire protection installations, electric power and telephone cables and lines and other utility connections, facilities and other improvements (above and below ground) which now exist or hereafter are constructed on the Property for use in common by Landlord, Tenant and other tenants located in the Building.
Exterior Common Area. Expenses: Calculated as set forth in Article 4 of this Lease. However, as set forth in Section 1.05 of this Indenture above, Landlord and Tenant hereby agree and acknowledge that the amount of Minimum Annual Rent required to be paid by Tenant under this Lease includes an amount attributable to Tenant’s Share of Exterior Common Area Expenses and consequently, Tenant shall have no obligation during the Term to pay an additional separate amount for Tenant’s Share of Exterior Common Area Expenses. (Section 4.02) 1.11 Enclosed Plaza Common Area Expenses: Calculated as set forth in Article 4 of this Lease. However, as set forth in Section 1.05 of this Indenture above, Landlord and Tenant hereby agree and acknowledge that the amount of Minimum Annual Rent required to be paid by Tenant under this Lease includes an amount attributable to Tenant’s Share of Enclosed Plaza Common Area Expenses and consequently, Tenant shall have no obligation during the Term to pay an additional separate amount for Tenant’s Share of Enclosed Plaza Common Area Expenses. However, Tenant shall at all times during the Term be responsible for paying directly to the operative contractor or service provider the monthly charges for electrical power to the Premises and trash removal from the Premises as set forth in Article 9 of this Lease. (Section 4.03)
Exterior Common Area as used herein shall mean the Common Area located on Parcel A as shown on such Parcel Map and any access drives and Common Area parking areas (if any) to the extent located elsewhere on Parcel A or elsewhere on the Land. The Land, the Common Area (including, without limitation, the Exterior Common Area referred to above and the Restricted Common Area referred to in Paragraph 11.1 below), the Building and any other building(s) or improvement(s) now or hereafter located on the Land are referred to herein collectively as the “Project.” Landlord and Tenant agree that all measurements of area contained in this Lease, including, without limitation, the size of the Premises, Building and Project, are an approximation which Landlord and Tenant agree are reasonable. Such measurements of area contained in this Lease also are conclusively agreed to be correct and binding upon the parties, and any subsequent determination that the area is more or less than shown in this Lease shall not result in a change in any way in the computations of Rentals; provided, however, in the event that Landlord constructs the retail building described in Paragraph 2.1(d) below or any other building on Parcel A or on any other portion of the Land, Taxes assessed or levied on such retail building or other building shall not be charged to Tenant and the Building’s percentage share of Exterior Common Area Operating Expenses shall be adjusted as provided in Paragraph 1.12 above.

Examples of Exterior Common Area in a sentence

  • Subtenant’s prorata share of such Operating Costs under this Sublease shall be 20.11% of Tenant’s Operating Cost Share relating solely to the Premises and 20.11% of Tenant’s Exterior Common Area Cost Share relating solely to the Premises, as those terms are defined in Section 7.1(a) of the Master Lease.

  • In the event that less than one hundred percent (100%) of the Building is occupied during any calendar year, all Exterior Common Area Expenses on the statements provided by Lessor shall be adjusted for each calendar year to equal Lessor's reasonable estimate of Exterior Common Area Expenses had one hundred percent (100%) of the total rentable area of the Building been occupied.

  • Landlord may obtain entitlements and permits for, and thereafter construct, an approximately 6,500 square foot retail building in the area identified on Exhibit E attached hereto (and located in a part of the southern portion of the Exterior Common Area).

  • Building Operating Expenses shall include ---------------- the Buildings equitable share of all direct costs of operation, maintenance, repair and management of the Project (as opposed to expenses relating solely to the Building or any other particular building within the Project) and/or the Exterior Common Area, determined by Lessor's standard accounting practices (collectively, "Project Expenses").

  • Such costs shall be allocated by Lessor between the Building containing the Premises and the other buildings located within the Project from time to time and having the right to use the Exterior Common Area, in such manner as Lessor reasonably determines in good faith.

  • In the event Lessor makes capital improvements which have the effect of reducing Exterior Common Area Expenses, Lessor may amortize its investment in said improvements as an Exterior Common Area Expense in accordance with standard accounting practices provided that such amortization is not at a rate greater than the anticipated savings in the Exterior Common Area Expenses.

  • The maintenance of the Exterior Common Area shall be at the sole discretion of Lessor and all costs incurred by Lessor in good faith shall be deemed conclusively binding on Lessee.

  • Statements of Exterior Common Area Expenses provided by Lessor shall be final and binding upon both Lessor and Lessee.

More Definitions of Exterior Common Area

Exterior Common Area means those areas and facilities provided for the use or benefit of tenants generally and/or the public, including the exterior of the Building and all Site Improvements on the Land, including, without limitation; (A) all parking areas, enclosed or otherwise, and all streets, sidewalks, signs and landscaped areas located on or within the Land; (B) all improvements and landscaped areas located in public rights-of-way directly contiguous to the Land if and to the extent Landlord maintains areas from time to time;
Exterior Common Area means those portions of the Property which are not located within the Building and which are provided and maintained for the common use and benefit of LESSOR and LESSEES of the Building generally and the employees, invitees, and licenses of LESSOR and such LESSEES; including, without limitations, all parking areas, enclosed or otherwise, and all streets, sidewalks, and landscaped areas.
Exterior Common Area is defined in Article 55. This Lease is subject to all of the terms, covenants and conditions set forth in this Lease. Tenant covenants as a material part of the consideration for this Lease to keep and perform each and all of said terms, covenants and conditions to be kept by Tenant under the Lease.
Exterior Common Area means that portion of the Common Area within the Project that is not located within the Building.
