Formal Level 3. If the Association is not satisfied with the disposition of the grievance at Level 2 by the Superintendent or designee, or if no disposition has been made within the period above provided, the Association may, within five (5) days after the receipt of the written decision at Formal Level 2 (or within five (5) days of the deadline for receiving the written decision), submit the grievance to the Board by filing a written copy thereof with the secretary or other designee of the Board. The Board, not later than its next regular meeting or within ten (10) days, whichever shall be later, will hold a hearing on the grievance. The Board shall allow the Association an opportunity to be heard at the meeting for which the grievance was scheduled. Within ten (10) days from hearing the grievance, the Board shall render its decision in writing. A copy of the written decision of the Board shall be forwarded to the President of the Association.
Formal Level 3. If the grievant is not satisfied with the disposition of Level 2 or if no decision has been rendered within ten (10) working days after the meeting with the Superintendent or designee, the grievant may file a written appeal with the Board of Education within ten(10)work days. After receiving the written grievance, the Board of Education shall arrange for a hearing on the grievance with the grievant and the Association representatives for the purpose of resolving the grievance. The final decision on the grievance at Level 3 will be rendered by the Board at its next regularly scheduled meeting following the hearing.
Formal Level 3. If the Association is not satisfied with the disposition of the grievance at Level 2 or if no disposition has been made within the period above provided, the Association may submit the grievance to arbitration before an impartial arbitrator. If the Association desires to submit a matter to Arbitration, a Demand for Arbitration shall be filed with the American Arbitration Association (with a copy to the Board) within ten (10) days after the Superintendent's Level 2 response.

Examples of Formal Level 3 in a sentence

  • A teacher with a grievance may proceed individually or together with his Association Representative or through the Association Representative through Formal Level 3 of the Grievance Procedure.

  • If requested, a meeting will be held within ten (10) work days following such presentation at Formal Level 3.

Neither the Employer nor the Union shall be permitted to assert in such arbitration proceeding any ground or to rely on any evidence not previously disclosed to the other party. The arbitrator shall have no power to alter, add to, or subtract from the terms of this Agreement. Both parties agree to be bound by the award of the arbitrator. The fees and expenses of the arbitrator shall be shared equally by the Union and Employer.

Formal Level 3. If the Union is not satisfied with the Superintendent's decision the Union may appeal the grievance to the Board of Education by filing a copy of the grievance with the Secretary of the Board. The appeal to the Employer must be made within five (5) consecutive days of the receipt of the Superintendent's decision. Both parties agree to be bound by the award of the arbitrator, and that judgment thereon may be entered in any court of competent jurisdiction.
