Grievance Defined. A grievance is a claim by a member of the bargaining unit that there has been a violation of misapplication of the provisions of this agreement. Listed below are the three levels through which a grievance must be filed. Under no circumstances should any of the steps listed below be circumvented. Level One: Within ten (10) days after the employee(s) becomes aware of an alleged violation of the agreement, the employee(s) shall request to meet with their immediate supervisor. At this meeting the employee(s) will cite the article and section of the agreement alleged to have been violated. The purpose of this meeting shall be to resolve the matter at hand. Persons to be present at this meeting shall include the employee(s) bringing the grievance and their immediate supervisor. The grievance shall be presented to the supervisor, in writing, and shall include, in specific language, the perceived violation. Upon receipt of the written grievance, and following discussion with the employee(s) involved, the supervisor will, within five (5) days, render a written decision, which shall include a rationale for the decision rendered. Grievant reserves the right to representation at this meeting. Level Two: In the event that the supervisor's decision, as set forth in level one, is unsatisfactory to the employee(s), they shall have the right to appeal the decision to the superintendent. This appeal shall be made in writing, and shall include the specific violation(s) as set forth above as well as the employee(s) objection to the decision rendered in level one. Grievance Defined. A “grievance” is hereby defined as an alleged violation of the terms of this Agreement by the County, an employee, or group of employees.
