Handback Requirements definition

Handback Requirements means the requirements for the condition of the Facility on the Expiry Date described in Section 2.1 of this Appendix;

Handback Requirements means the terms, conditions, requirements and procedures governing the condition in which Developer is to deliver the Project and Project Right of Way to TxDOT upon expiration or earlier termination of the Agreement and Lease, as set forth in Section 19.4 of the Technical Provisions.

Handback Requirements means the Contractor’s obligations to hand back the New Infrastructure and the Existing Infrastructure at the end of the Term in the condition required by Schedule 18 (Technical Requirements), including any amendments deemed to be made by the operation of Section 6.6;

• Developer also shall perform Renewal Work according to the other applicable terms of the Technical Provisions, including, when applicable, the Handback Requirements.

• Thereupon, Developer shall deliver such transfers, assignments and other documents, and take such other actions, as TxDOT or the depository institution for the Handback Requirements Reserve shall require to confirm transfer to TxDOT of the Handback Requirements Reserve and funds therein, free and clear of all liens, pledges and encumbrances.

Handback Requirements means the requirements set out or identified or referred to in paragraph 1 of Part 4 of Schedule 4 [Handback Requirements] as amended from time to time by any Department's Change.
