Handback Works definition

Handback Works has the meaning set out in Section 1.3(a) of Appendix 4B [Handback Requirements];
Handback Works has the meaning given in Section 2.3(a) of this Appendix; and “Handback Works Plan” has the meaning given in Section 2.3(b) of this Appendix;

Examples of Handback Works in a sentence

  • The Authority’s Operating Period Representative may, within 20 Business Days after receipt of the Handback Works and Handback Works Plan, review and comment on such plan in accordance with Section 3.9 of Schedule 4.

  • If it is agreed or determined in accordance with Clause 47 (Expert Determination) that the Toll Road did not, at the Expiry Date, comply in all respects with the Handback Requirements, the Developer shall pay to the Grantor an amount equal to the estimated cost of completing such Handback Works or procuring that the Toll Road comply in all respects with the Handback Requirements.

  • The Developer shall carry out the Handback Works at its own cost notwithstanding that the actual cost of the Handback Works may be higher than the Handback Amount.

  • To assure NROCC that THJ will comply with its handback obligations TJH must within 7 days after the Handback Works, the Handback Programme and the Handback Amount is agreed with NROCC or determined by the expert procure that a bank shall deliver to NROCC a bond (“the Handback Bond”) for the Handback Amount.A further joint inspection will be carried no later than one year before the expiration date to determine whether it can reasonably be expected that the Toll Road will meet the Handback Requirements.

  • If any element of the Toll Road is found to fall short ofthe Handback Requirements, then TJH shall provide to NROCC a proposal to undertake the necessary Handback Works and a plan to carry out such works (“the Handback Programme”) and the estimated cost of such works (“the Handback Amount”).

  • On agreement, or determination in accordance with Clause 47 (Expert Determination), of the Handback Works, the Handback Programme and/or the Handback Amount (as the case may be), the Developer shall procure that the Handback Works are carried out in accordance with the Handback Programme.

  • Any notice given by the Grantor's Representative in accordance with Clause 38.9 shall set out each respect in which the Handback Works have not been completed or the Toll Road does not comply with the Handback Requirements and shall state the Grantor's estimate of the cost of procuring that the Toll Road complies in all respects with the Handback Requirements.

  • The Grantor shall notify the Developer of any Handback Works which are still outstanding and the Developer shall promptly complete such Handback Works at its own cost.

  • For the avoidance of doubt, the Environmental Condition Survey and the Remediation Handback Works and any Further Remediation Handback Works shall be carried out at the sole cost and expense of the Contractor.

  • Save in the case of any relevant site to which paragraph 9 applies the Contractor shall procure that the Remediation Handback Works which are the subject of the Remediation Handback Contract are carried out at the relevant Site and completed within the Remediation Handback Period relevant to that Site.


More Definitions of Handback Works

Handback Works has the meaning given in Schedule Part 18 (Handback Procedure);
Handback Works means the maintenance works (if any) required to be carried out in respect of the Facilities in order to procure that they will, on the Expiry Date, satisfy the Handback Requirements;

Related to Handback Works

  • Work/ works means work / works to be executed in accordance with the contract.

  • The Works means the work or works to be executed or done under this contract.

  • Sewage works means all facilities for collecting, pumping, treating, and disposing of sewage.

  • Nail technician means any person who for compensation manicures or pedicures natural nails, or who performs artificial nail services for compensation, or any combination thereof.

  • Urgent Works means any urgent measures, which in the opinion of the Engineer-in-charge become necessary during the progress of the work to obviate any risk of accident or failure or which become necessary for security.

  • Day works means varied work inputs subject to payment on a time basis for the Service Provider's employees and equipment, in addition to payments for associated materials and administration.

  • audiovisual work means a work that consists of a series of related images which impart the impression of motion, with or without accompanying sounds, susceptible of being made visible and, where accompanied by sounds, susceptible of being made audible;

  • Customer Technology means Customer's proprietary technology, including Customer's Internet operations design, content, software tools, hardware designs, algorithms, software (in source and object forms), user interface designs, architecture, class libraries, objects and documentation (both printed and electronic), know-how, trade secrets and any related intellectual property rights throughout the world (whether owned by Customer or licensed to Customer from a third party) and also including any derivatives, improvements, enhancements or extensions of Customer Technology conceived, reduced to practice, or developed during the term of this Agreement by Customer.

  • Supplier Software means software which is proprietary to the Supplier or its Affiliates which is used or supplied by the Supplier in the provision of the Services; Supplier Staff means all persons employed or engaged by the Supplier together with the Supplier's servants, agents, suppliers, consultants and Sub-Contractors (and all persons employed by any Sub-Contractor together with the Sub-Contractor’s servants, consultants, agents, suppliers and Sub-Contractors) used in the performance of its obligations under this Contract; Time and Materials means the pricing mechanism for the Services as may be agreed by the Parties and set out at paragraph Error: Reference source not found in the SOW; TUPE means the Transfer of Undertakings (Protection of Employment) Regulations 2006 (SI 2006/246) as amended or replaced or any other regulations or UK legislation implementing the Acquired Rights Directive; Velocity means the Metric which measures the total number of Story Points for Stories that have been accepted in a Sprint, indicating the rate of progress towards Acceptance of all Stories from the Product Backlog;

  • literary work means any work, other than a dramatic or musical work, which is written, spoken or sung, and accordingly includes—

  • Commercial Software means Software developed or regularly used that: (i) has been sold, leased, or licensed to the general public; (ii) has been offered for sale, lease, or license to the general public; (iii) has not been offered, sold, leased, or licensed to the public but will be available for commercial sale, lease, or license in time to satisfy the delivery requirements of this Contract; or (iv) satisfies a criterion expressed in (i), (ii), or (iii) above and would require only minor modifications to meet the requirements of this Contract.

  • Licensed Software includes error corrections, upgrades, enhancements or new releases, and any deliverables due under a maintenance or service contract (e.g., patches, fixes, PTFs, programs, code or data conversion, or custom programming).

  • Collective Work means a work, such as a periodical issue, anthology or encyclopedia, in which the Work in its entirety in unmodified form, along with a number of other contributions, constituting separate and independent works in themselves, are assembled into a collective whole. A work that constitutes a Collective Work will not be considered a Derivative Work (as defined below) for the purposes of this License.

  • Developed Software means software specifically designed for the Principal under the Contract. Depending how advanced its development is, it may be either a Product or a Service or both.

  • musical work means a work consisting of music, exclusive of any words or action intended to be sung, spoken or performed with the music;

  • live-work unit means a unit intended for both residential and non-residential uses concurrently;

  • piece-work means any work the pay for which is estimated by the amount of work performed irrespective of the time occupied in its performance;
