Hazardous or Toxic Materials definition

Hazardous or Toxic Materials as used in this Lease shall mean those materials identified in The Comprehensive Environmental Response, Compensation and Liability Act of 1980 of the United States Code and by the laws of the Commonwealth of Virginia, as such sections may be amended from time to time;
Hazardous or Toxic Materials means any materials which may be deemed hazardous or toxic including, but not limited to, (i) materials defined as “hazardous waste” under the Federal Resource Conservation and Recovery Act and similar state laws; (ii) “hazardous substances” as identified under the Federal Comprehensive Environmental Response, Compensation and Liability Act and especially in CERCLA Section 101(14) and as set forth in Title 40, Title of Federal Regulations, Part 302; (iii) those elements or compounds which are contained in the list of hazardous substances adopted by the United States Environmental Protection Agency (“EPA”) and the list of toxic pollutants designated by Congress or the EPA or defined by any other federal, state or local statute, law, ordinance, code, rule, regulation, order or decree regulating, relating to, or imposing liability or standards of conduct concerning, any hazardous, toxic, polluting, or dangerous waste substance or material, as such lists are now or at any time hereafter in effect; (iv) asbestos; (v) radon; (vi) polychlorinated biphenyl; (vii) petroleum products; and (viii) such other materials, substances or waste which are otherwise dangerous, hazardous, harmful or deleterious to human, plant or animal health or well being.
Hazardous or Toxic Materials means any chemicals, gasses, solids, liquids, and any other materials or substances that pose a present or potential hazard to human health or safety or the environment.

Examples of Hazardous or Toxic Materials in a sentence

  • Under no circumstances shall any remediation by Tenant leave any Hazardous or Toxic Materials at, in, or under the Premises, the Land, or the Building without first obtaining the prior written consent of Landlord.

  • Tenant shall not incorporate into, use, release, conduct any activity that will produce, or otherwise place or dispose of at, in, under or near the Premises, the Building or the Land any Hazardous or Toxic Materials.

  • The Lessee agrees not to employ or utilize the Premises for the purpose of disposing, treating, storing, handling or transporting any materials which may be deemed to constitute Hazardous or Toxic Materials, unless it obtains the prior written consent of the Lessor.

  • Landlord shall have the right to periodically inspect, take samples for testing and otherwise investigate the Premises for the presence of Hazardous or Toxic Materials.

  • Hazardous or Toxic Materials No asbestos-containing material, heavy metal-containing paints/coating, or PCB-containing materials will be specified or used in the Work, including, but not limited to, building materials, production processes and equipment, and utilities and other support processes and equipment.


More Definitions of Hazardous or Toxic Materials

Hazardous or Toxic Materials means asbestos, lead, silica dust, toxic dust, “fungi”, bacteria, organic pathogens, bio-organic growth or systemic chemical poison.
Hazardous or Toxic Materials means any substance or material which is (i) designated, defined, classified or regulated as a hazardous substance, hazardous material, hazardous waste, pollutant or contaminant under any Applicable Laws, as currently in effect as of the date of this Agreement, (ii) petroleum hydrocarbon, including crude oil or any fraction thereof and all petroleum products or materials and substances containing petroleum or other hydrocarbons, (iii) PCBs, (iv) lead, (v) friable asbestos, (vi) flammable explosives, (vii) infectious materials or (viii) radioactive materials.
Hazardous or Toxic Materials means oil or petrochemical products, PCBs, asbestos, urea formaldehyde, flammable explosives, radioactive materials, hazardous wastes, toxic substances or related materials, including, without limitation, any substances defined from time to time as or included in the definition of "hazardous substances," "hazardous materials," or "toxic substances" under any applicable federal, state or local laws or regulations.
Hazardous or Toxic Materials means all materials, substances, wastes and chemicals classified, defined, listed or regulated as, or containing, a “hazardous substance,” “hazardous waste,” “toxic substance,” “pollutant,” “contaminant,” “oil,” “hazardous material,” solid waste,” and/or “regulated substance” under any Environmental Law. As used herein, the termEnvironmental Laws” shall mean any and all statutes, rules, regulations, ordinances, orders, permits, licenses, and other applicable legal requirements, relating directly or indirectly to human health or safety or the environment, or the presence, handling, treatment, storage, disposal, recycling, reporting, remediation, investigation, or monitoring of hazardous or toxic materials.
Hazardous or Toxic Materials includes, but is not limited to: (i) materials defined as "Hazardous Waste" or hazardous substances under the Federal Resource Conservation and Recovery Act or similar state laws; and (ii) "hazardous substances" as identified under the Federal Comprehensive Environmental Response, Compensation and Liability Act of 1980 ("CERCLA"), 42 U.S.C. Section 9601, et. Beg., the Federal Superfund Amendments and Reauthorization Act of 1986, the Florida Resource Recovery and Management Act, the Florida Pollutant Spill Prevention and Control Act and all Federal, state or local environmental statutes, laws, ordinances, codes, rules and regulations (whether now existing or hereafter created) promulgated, adopted, entered or issued, as all of the foregoing may be amended from time to time; and (iii) those elements or compounds which are contained in any list of hazardous substances adopted by the EPA and any list of toxic pollutants or contaminants designated by Congress or the EPA (including, without limitation, those set forth in Section 101(14) of CERCLA and in Title 40, Code of Federal Regulations, Part 302) or defined by any other Federal, state or local statute, law, ordinance, code, rule, regulation, order or decree regulating, relating to, or imposing liability or standards of conduct concerning, any hazardous, toxic, polluting, or dangerous waste, substance or material, as such lists are not or at any time hereafter in effect; and (iv) asbestos; and (v) radon; and (vi) polychlorinated biphenyls; and (vii) petroleum and petroleum products (including those described in Chapter 376, Florida Statutes); and (viii) such other materials, substances or waste which are otherwise dangerous, hazardous, harmful or deleterious to human, plant or animal health or well being or the environment. 32.

As used herein, the termEnvironmental Laws“ shall mean any and all statutes, rules, regulations, ordinances, orders, permits, licenses, and other applicable legal requirements, relating directly or indirectly to human health or safety or the environment, or the presence, handling, treatment, storage, disposal, recycling, reporting, remediation, investigation, or monitoring of hazardous or toxic materials.

As used herein, the termEnvironmental Laws” shall mean any and all statutes, rules, regulations, ordinances, orders, permits, licenses, and other applicable legal requirements, relating directly or indirectly to human health or safety or the environment, or the presence, handling, treatment, storage, disposal, recycling, reporting, remediation, investigation, or monitoring of hazardous or toxic materials. Notwithstanding the foregoing this clause acknowledges that numerous building materials and standard office products and supplies contain materials, which may or may not be inherent in their makeup, which are or contain hazardous substances. Therefore, the lease will be interpreted fairly and reasonably by all Parties in a manner consistent with sound judgment and reasonableness and in accordance with standard and reasonable consulting engineering office practices.
