Licensee Business means with respect to the referenced entity (whether Licensee or a Sublicensee), the business owned by the entity for the purchase and sale of goods and related services to customers who take delivery within the Territory using interfaces that are solely in the English language, and the associated marketing and related business programs conducted by the entity in the English language within the Territory, and related business transactions performed by and between the entity and its respective vendors, suppliers, distributors and other agents. Notwithstanding the foregoing, no Licensee Business shall include any activities involving the operation of life support machines, weapons systems, aircraft navigation or communication systems, air traffic control, nuclear facilities or any other environment requiring fail- safe performance in which any failure or delay in performance could lead to death, personal injury or severe physical or environmental damage.

Licensee Business means the business of offering family history services and products that are a part of the Licensee’s or Licensor’s Business, on or before the License Effective Date and a DNA services business as contemplated on or before the License Effective Date by Licensee. Notwithstanding the foregoing, the Licensee Business expressly excludes the People Search Business, the Identity Business, and providing the Platform or any Licensor Intellectual Property to any third party, except as authorized under Section 2.1 or 2.
