For the duration of the Licensing Period, the Provider shall provide the User with a guarantee of the functional and user parameters of the Software set out in the Technical Specification, and the Parties agree that this guarantee shall be applied exclusively in accordance with the procedure set out in Article 5.2 of this Agreement.
In the event that the Service has not been available for at least 95% of the time during a given Licensing Period, the User is entitled to request in writing from the Provider a price reduction in the form of a refund of a proportionate part of the Licensing Fee already paid.
