Maximum Bonus (exclusive of a signing bonus) – Authority to negotiate an increase of up to 15 percent or $30,000, whichever is higher, on all incentives or bonuses.
This authority applies the 15 percent limit to the overall cumulative total (before and after negotiation) for Maximum Bonus under the new and old contracts.
The fourth, and largest percentage of the Maximum Bonus, is earned by ensuring that (i) the Group 1 Asset Sales close within forty-five (45) calendar days of the Petition Date, and (ii) the Group 2 Asset Sales close within eighty-nine (89) calendar days of the Petition Date.
Finally, the last 10% of the Maximum Bonus requires the Eligible OpCo Employees to work ninety-five percent (95%) of all Business Days from the Petition Date to and including the Plan Effective Date, ensuring that the Eligible OpCo Employees stay engaged instead of focused on their next endeavor.
