Minimum Occupancy Requirement definition

Minimum Occupancy Requirement means for an Eligible Project a minimum Resident Occupancy of (A) 50% by the sixth (6th) Operating Month, (B) 70% by the ninth (9th) Operating Month and (C) 85% by the twelfth (12th) Operating Month and thereafter.
Minimum Occupancy Requirement means for an Eligible Project a minimum Resident Occupancy for the particular type and model of Facility as set forth in Section 7.2.2 hereof.
Minimum Occupancy Requirement means Tenant, and/or an Affiliate(s) and/or a Person that is a Successor(s) to Tenant being in occupancy of at least thirty-three percent (33%) of the rentable square feet in the Premises.

Examples of Minimum Occupancy Requirement in a sentence

  • Tenant shall be permitted to station a concierge in the lobby of the Building as contemplated by this Section 3.10 only during the period that the Minimum Demise Requirement is satisfied, the Minimum Occupancy Requirement is satisfied and the Initial Tenant Requirement is satisfied.

  • So long as the Minimum Occupancy Requirement is satisfied, in the event of an increase in the assessment of the Property for Property Tax purposes, Tenant may request that Landlord appeal the increased assessment.

More Definitions of Minimum Occupancy Requirement

Minimum Occupancy Requirement means the requirement that Tenant (and/or an Affiliate of Tenant) together with any Special Occupants occupies at least eighty percent (80%) of the Rentable Area that is then demised by this Lease for the conduct of business.
Minimum Occupancy Requirement means for a Development Project including an Expansion Project shall have the meaning set forth in Section 7.2.2(d), for a Stabilized Project, "Minimum Resident Occupancy" for such Eligible Project shall mean 85% Resident Occupancy, measured on a quarterly basis and for an "Acquisition Project" shall have the meaning set forth in Section 7.2.2(e).

Minimum Occupancy Requirement means, for any Property, the aggregate occupancy level for the preceding calendar quarter of tenants in possession and paying rent (not more than sixty (60) days past due) and which are not otherwise in default under their respective leases was at least eighty percent (80%) of the aggregate rentable area within such Property.
