Monthly availability rate means the total number of minutes in the month minus the number of minutes of unavailability in the month in question, divided by the total number of minutes in the month in question.

Monthly availability rate means the percentage calculated, for a calendar month M, according to the following formula: An "Interruption" shall mean a server-side user error rate greater than five percent (5%) on the domain associated with the Software. Unavailability of the Software does not include the following cases: ● maintenance operations carried out by TOUCANTOCO; ● Force Majeure as such is defined in the Terms; ● events not attributable to TOUCANTOCO (such as problems with the Internet network, unavailability of the Licensee and/or End Users’ network or its Internet service provider, unreasonable and excessive use likely to affect the stability of the Software); ● interruptions related to changes made to the Software by the Licensee or third parties without TOUCANTOCO’s authorization; and ● inaccessibility due to non-compatible equipment and/or the Licensee’s terminals.
