Each Neighborhood will be subject to the Declaration, and will also be subject to a separate Neighborhood Declaration that will, among other things, create a separate Neighborhood Association which will be governed by its own separate Articles of Incorporation and Bylaws.
The Neighborhood Representative shall be appointed by the President of its Neighborhood Association at a duly constituted meeting of the Neighborhood Association Board of Directors, or elected by the members of a Neighborhood at the individual Neighborhood Association’s annual meeting, if so directed by its applicable Neighborhood Declaration.
The Board of Directors shall allocate to each Neighborhood the expenses incurred or anticipated to be incurred by the Association with respect to its obligations under this Declaration, any Supplemental Declaration or any Neighborhood Declaration with respect to a particular Neighborhood which shall include, but not be limited to, maintenance of trees, sod or other plantings on a Lot or in the unpaved right of way abutting a Lot, including replacements thereof.
These easements include the right to cut any trees, bushes, or shrubbery, make any gradings of the soil, or to take any other action reasonably necessary to install utilities and to maintain reasonable standards of health and appearance but shall not include the right to disturb any improvements erected within the Neighborhood Properties that are not located within the specific easement area, designated on the plat or in this Neighborhood Declaration.
The following provisions shall be subject to any architectural review procedures or requirements established by the Master Association, and in the event of conflict between the terms or conditions of this Neighborhood Declaration and the terms and conditions of the Master Declaration, the Master Declaration shall supersede and control.
