Operator Representative definition

Operator Representative has the meaning specified in Section 6.4.

Operator Representative means the person nominated as such in Schedule 1 (Contract Particulars), or such other person as may be appointed from time to time to replace that person in accordance with Clause 5.4. Operator’s Background IP means any Intellectual Property Rights of the Operator (or licensed to the Operator by a third party) which: (a) are in existence before the date of this Agreement or come into existence after the date of this Agreement, other than Project IP; and (b) the Operator makes available, contributes, brings to or uses in connection with the performance of this Agreement, the Project, the or Services, and Subcontractor’s Background IP has a corresponding meaning in respect of Intellectual Property Rights of a Subcontractor. Operator’s Design Management Plan means the plan of that name prepared in accordance with this Agreement, including Section F.5.2. of Schedule 7 (Pre-Operational Services Specifications). Parent Guarantee means the parent company guarantee in the form set out in Schedule 6 (Parent Guarantee).

Operator Representative shall have the meaning ascribed to such term as set forth in Section 21.19.2.

Examples of Operator Representative in a sentence

• The manner of making any decision or giving any approval by Operator shall be determined by Operator for itself, but any communication received by Owner from a Person designated by Operator as its Operator Representative (unless such designation shall have been previously revoked) may be conclusively relied upon by Owner as having been authorized by Operator.
