permanent job vacancy as used herein means a new or additional job created by the Employer or a vacancy which has been created by the quit, discharge or retirement of an employee or an increase in the workforce. Vacancies created by reason of sickness, accident or leaves of absence are not "permanent job vacancies" within the meaning of this Article. Nothing contained herein shall be interpreted as requiring the Company to fill any vacancy. If there are no qualified applicants, the Company may fill the vacancy by hiring a new employee. The job posting provided for herein shall apply only in respect of the original vacancy and the vacancy, if any, resulting from the filling of the original vacancy, and need not apply to any subsequent vacancies. (Note: Subject to the finalizing classifications Labour Grade 1 contains the following classifications: Machine Operator (including Deburr Operator), General Help, Shipper/Receiver, and Back End Operator)

In any event, the temporary posting for such temporary work will be limited to a maximum of 120 calendar days and after the maximum number of calendar days has been reached, it will be reposted as a permanent posting.

The successful applicant will fill the vacancy only until the absent employee returns to his job. The employee who is then returned to his former position.

  • Permanent Incapacity as used herein shall mean mental or physical incapacity, or both, reasonably determined by the Company's Board of Directors based upon a certification of such incapacity by, in the discretion of the Company's Board of Directors, either Executive's regularly attending physician or a duly licensed physician selected by the Company's Board of Directors, rendering Executive unable to perform substantially all of his duties hereunder and which appears reasonably certain to continue for at least six consecutive months without substantial improvement. Executive shall be deemed to have "become permanently incapacitated" on the date the Company's Board of Directors has determined that Executive is permanently incapacitated and so notifies Executive.
