Phase III Expansion means pipeline expansions, underpinned by long-term, fee-for-service agreements in Pembina's operating areas, following and expanding on certain segments of Pembina's existing Northern and Peace Pipeline systems from Taylor, British Columbia southeast to Edmonton, Alberta increasing the capacity on the system by approximately 420 mbpd;
Phase III Expansion is as generally described on Exhibit F attached hereto and shall include such changes thereto or modifications thereof as Developer may from time to time determine, provided that any such changes or modifications, whether individually or in the aggregate, do not materially and adversely affect the current operation or use of the Xxxxxxxx Rail Terminal Facility. For purposes of this Agreement, the “Phase III Expansion” shall be those development, construction and operational activities and rights conducted in, on, over, across and under the Xxxxxxxx Rail Property, it being acknowledged by the Parties that other Phase III Expansion development, construction and operational activities and rights will or may also be conducted by Developer on the Undeveloped Land and/or on any Future Acquired Land.

More Definitions of Phase III Expansion

Phase III Expansion means the respective expansion projects shown on Schedule 5 as the “Hearthstone A,” “Hearthstone B” and “Hearthstone C” Community Expansions, respectively. Landlord shall have no obligation to make any disbursement of Expansion Funds during the continuance of any Event of Default. Any disbursement of Expansion Funds shall be made, and all work in connection with any Expansion shall be performed, in accordance with Landlord’s reasonable and customary construction disbursement and completion requirements and pursuant to a development addendum or expansion agreement to be entered into in connection with such Approved Expansion. Upon any disbursement of Expansion Funds, Landlord’s Investment shall be increased in the amount of such disbursement in accordance with Section 2.2(a), and the amount of Minimum Rent and Additional Rent then payable shall be recalculated and reset in accordance with Section 2.1. Landlord’s commitment to make the Expansion Funds available shall be cancelled, and Landlord’s obligation to disburse any remaining Expansion Funds shall terminate, on the date that is (i) three (3) years after the date hereof with respect to the Phase I Expansion and Phase II Expansion (provided that, subject to the other terms and conditions of this Section 8.4(b), Landlord shall remain obligated to disburse such Expansion Funds as may be required to complete any approved work in connection with a Phase I Expansion or Phase II Expansion then in process), or (ii) such date determined by Landlord with respect to any approved Phase III Expansion.

  • Phase III means Phase I (or Phase I/II), Phase II (or Phase II/III) and Phase III clinical trials, respectively, in each case as prescribed by applicable FDA IND Regulations, or any corresponding foreign statutes, rules or regulations.

  • Phase III Clinical Trials means a Clinical Trial for the Product on sufficient numbers of patients to generate safety and efficacy data to support Regulatory Approval in the proposed therapeutic indication, conducted in accordance with current good clinical practices and in accordance with a protocol that has been reviewed by the FDA and reflects any comments or concerns raised by the same.

  • Development Site means any parcel or lot on which exists or which is intended for building development other than the following:

  • Phase 2 Trial means a human clinical trial conducted on study subjects with the disease or condition being studied for the principal purpose of achieving a preliminary determination of efficacy or appropriate dosage ranges, as further described in 21 C.F.R. §312.21(b) (including any such clinical study in any country other than the United States).

  • Phase III Clinical Trial means a large, controlled or uncontrolled Clinical Study that would satisfy the requirements of 21 CFR 312.21(c), intended to gather the additional information about effectiveness and safety that is needed to evaluate the overall benefit-risk relationship of the drug and to provide an adequate basis for physician labeling.

  • Annual Work Plan and Budget means the work plan and budget approved by the Bank and adopted by the Borrower in accordance with the provisions of Section I.C of Schedule 2 of this Agreement, as said work plan and budget may be modified from time to time with the written agreement of the Bank.
