If at the time of exercise of Purchaser’s option, the Production Budget is not set, then the minimum amount set forth above will be paid to Owner upon exercise of the Option and adjusted as necessary upon commencement of principle photography.
For purposes of Music Videos with a Production Budget of $200,000 or less, scale payment shall be the compensation negotiated by the performer.
If any of the following Critical Path Deadlines are not met, the Production Schedule and/or Production Budget may be effected.
For videos with a Production Budget of $200, 000 or less, the Company shall pay to each performer a re-use fee of $175 per production which shall be compensation for all other commercial uses, if any, other than those set forth above of a music video or part thereof.
If Licensee chooses to pay such license fee, it will obtain the same rights as if that program were an Output Program (except that the budget for that program will not be included under the Production Budget for Output Programs for that year).
