Public Lender Information information and documentation that is either exclusively (i) of a type that would be publicly available if Holdings and its respective Subsidiaries were public reporting companies or (ii) not material or inside information with respect to Holdings and its respective Subsidiaries or any of their respective securities for purposes of foreign, United States Federal and state securities laws.

  • Any information and documentation that is not Public Lender Information is referred to herein as “Private Lender Information”.

  • You agree that, unless expressly identified as Public Lender Information, each document to be disseminated by the Lead Arrangers to any Lender in connection with the Term Loan Facility will be deemed to contain Private Lender Information (except with respect to those documents described in clauses (x), (y) and (z) of the second preceding sentence).
