Punch List Item definition

Punch List Item means any uncompleted or deficient part of the IT System as specified in a Provisional Acceptance Certificate, the lack of which or the failure to complete which, considered individually or in aggregate with all other Punch List Items, does not adversely affect:
Punch List Item means a portion or element of the Work whose lack of completion does not interfere with complete use of and access to the Project, as determined by the Owner in its reasonable discretion.
Punch List Item means each item identified by the Company or by a contractor pursuant to an EPC Contract that, as of the Commercial Operations Date, remains to be completed, which shall consist only of those items of work (a) that are associated with, and were intended to have been completed prior to the Commercial Operations Date, (b) that do not preclude the Project or a system of the Project from operating or functioning as the Project or such system was designed and intended to operate, (c) the absence of which does not create any occupational hazard or hazard that precludes the safe and reliable operation of the Project or a system of the Project in accordance with Prudent Industry Practices, and (d) the completion of which will not unreasonably interrupt or interfere with the commercial operation of the Project.

Examples of Punch List Item in a sentence

  • Upon completion of a Seller Punch List Item, Purchaser shall release the corresponding portion of the Punch List Holdback to Seller within five (5) Business Days.

  • Contractor agrees that installation of the fiber optic cable and connection to the Project’s SCADA system is not an Interim Punch List Item.

  • Upon Owner making such election, Contractor shall forfeit any return of such portion of the Punch List Holdback and Contractor’s obligation to perform such Punch List Item shall be deemed satisfied.

  • The County may, in its discretion, waive (in writing) any Occupancy Readiness Condition, and the failure to meet any such requirement shall constitute a Punch List Item.

  • If the parties are unable to agree whether any particular item is to be included as a Punch List Item or whether the same has been satisfactorily completed, then the decision of Landlord's architect shall be binding.

  • Any disputes as to the nature or existence of any Punch List Item or as to the substantial completion of the Landlord Improvements shall be resolved by reasonable and joint decision of the Architect and a duly licensed Minnesota architect selected by Tenant.

  • If Contractor fails to perform any Punch List Item on the Punch List within sixty (60) Days after the Substantial Completion Date, Owner may elect by written notice to Contractor to retain the Punch List Holdback applicable to such Punch List Item and complete such Punch List Item itself.

Related to Punch List Item

  • Punch List Items means such items (i) as are reasonably necessary or appropriate to fully complete the construction, equipping and furnishing of the Hotel in accordance with this Contract and (ii) that, unless otherwise agreed by Buyer in its sole discretion, (a) individually and in the aggregate do not and will not prohibit, cause a delay in or otherwise adversely affect, under applicable Legal Requirements, the Franchise Agreement or otherwise, the opening of the Hotel for business to the public or the continued occupancy and operation of the Hotel as contemplated under the Brand and (b) may be corrected or completed, subject to delays caused by Force Majeure, within not more than sixty (60) days.

  • Punch List means the list of items, prepared in connection with the inspection of the Project by the Owner’s Representative or Architect in connection with Substantial Completion of the Work or a portion of the Work, which the Owner’s Representative or Architect has designated as remaining to be performed, completed or corrected before the Work will be accepted by the Owner.

  • Punchlist means a list of items of Work to be completed or corrected by Contractor after Substantial Completion. Punchlists indicate items to be finished, remaining Work to be performed, or Work that does not meet quality or quantity requirements as required in the Contract Documents.

  • Contract Item or “Contract Items” means the list of items identified in Section

  • Price List Item means those SAP Cloud Services that are identified in the Solution Exhibit of this Agreement. The Parties may include additional Price List Items by written agreement.

  • Project Schedule means a document that, with respect to each Phase of the Project, identifies, coordinates and integrates the anticipated design and construction schedules, the Contracting Authority’s and Owner's responsibilities, government authority reviews and other activities as are necessary for the timely completion of the Work.

  • Project Completion Schedule means the progressive Project Milestones set forth in Schedule-J for completion of the Project Highway on or before the Scheduled Completion Date;

  • Construction Drawings means those drawings containing the technical details associated with the design, construction and installation of the Infrastructure;

  • Major repair means either: (1) for a dispersal system, repairs required for an OWTS dispersal system due to surfacing wastewater effluent from the dispersal field and/or wastewater backed up into plumbing fixtures because the dispersal system is not able to percolate the design flow of wastewater associated with the structure served, or (2) for a septic tank, repairs required to the tank for a compartment baffle failure or tank structural integrity failure such that either wastewater is exfiltrating or groundwater is infiltrating.

  • Tenant Improvement Work means the construction of the Tenant Improvements, together with any related work (including demolition) that is necessary to construct the Tenant Improvements.

  • Construction Schedule means a construction schedule indicating the planned start and completion dates of the major activities of the Work as set out in Appendix [ ], a future Appendix;

  • Extra Work means any work which is determined by City to be necessary for the proper completion of the Project, but which the Parties did not reasonably anticipate would be necessary at the execution of this Agreement. Consultant shall not perform, nor be compensated for, Extra Work without written authorization from City’s Representative.

  • Completion Schedule means the fulfilment of the Related Services by the Supplier in accordance with the terms and conditions set forth in the Contract;

  • Construction Budget means the fully-budgeted costs for the acquisition and construction of a given parcel of real property (including, without limitation, the cost of acquiring such parcel of real property, reserves for construction interest and operating deficits, tenant improvements, leasing commissions, and infrastructure costs) as reasonably determined by the Parent in good faith.

  • piece-work means any work the pay for which is estimated by the amount of work performed irrespective of the time occupied in its performance;

  • Detailed Project Report or ‘‘DPR’’ means the detailed project report relating to Station Development Project and Redevelopment Project attached hereto;

  • Tenant Improvements Defined in Exhibit B, if any.

  • Nonconforming sign means a sign or sign structure, other than a nonstandard sign or a sign that is erected and maintained in a business area along a scenic byway prior to the designation as a scenic byway, that satisfies 1 of the following:

  • Nonconforming structure means a structure the size, dimension or location of which was lawful prior to the adoption, revision or amendment of a zoning ordinance, but which fails to conform to the requirements of the zoning district in which it is located by reasons of such adoption, revision or amendment.

  • Final Completion Certificate has the meaning set forth in Section 11.6.

  • Installation Work means the construction and installation of the System and the Start-up, testing and acceptance (but not the operation and maintenance) thereof; all performed by or for the Power Producer at the Premises.

  • Substantial Completion means the stage in the progress of the work as determined and certified by the Contracting Officer in writing to the Contractor, on which the work (or a portion designated by the Government) is sufficiently complete and satisfactory. Substantial completion means that the property may be occupied or used for the purpose for which it is intended, and only minor items such as touch-up, adjustments, and minor replacements or installations remain to be completed or corrected which:

  • Erection, construction, remodeling, repairing means all types of work done on a particular building or work at the site thereof in the construction or development of the project, including without limitation, erecting, construction, remodeling, repairing, altering, painting, and decorating, the transporting of materials and supplies to or from the building or work done by the employees of the Contractor, Subcontractor, or Agent thereof, and the manufacturing or furnishing of

  • Contract Drawings means only those drawings specifically entitled as such and listed in the Specifications or in any Addendum, or any drawings furnished by the Commissioner, pertaining or supplemental thereto.

  • Standard Specifications means a compilation in book form of specifica- tions approved for general application and repetitive use;

  • Project Completion means completion of the Redevelopment in accordance with this Agreement to the state where the whole of the Morley Shopping Centre, as so redeveloped, is capable of occupation for its intended purpose;
