Real Property Documentation definition

Real Property Documentation means, with respect each parcel or tract of the Mortgaged Real Estate:
Real Property Documentation means, with respect to each parcel or tract of the Mortgaged Real Estate, a Mortgage, mortgagee policy of title insurance in an amount not to exceed (a) 110% of the fair market value of the Mortgaged Real Estate in jurisdictions that impose mortgage recording taxes (or other such lower amount as the Administrative Agent may approve), all as subject to the title insurance regulations in the state where the Mortgaged Real Estate is located or (b) the amount of debt secured by such property (or other such lower amount as the Administrative Agent may approve), fixture filings (if applicable), environmental reports and assessments (if available), flood zone certificates, surveys, and such other instruments, documents and certificates as Administrative Agent may reasonably require, all of which shall be in form and substance reasonably satisfactory to the Administrative Agent.
Real Property Documentation means the following as to each parcel of the Real Properties (except that the Agent may in its discretion waive or suspend the requirement for delivery of certain of the Real Property Documentation for any of the Real Properties, unless and until it notifies the Borrower or the relevant Guarantor that such requirement shall be imposed (which notice it may give in its sole discretion and shall give if requested by the Required Lenders, and the right to give such notice and impose such requirement, whether or not a Default or Event of Default is in existence, is expressly reserved):

Examples of Real Property Documentation in a sentence

  • The Agent shall have received a Mortgage and all Real Property Documentation for each parcel or tract of the Initially Selected Real Estate that constitutes Accepted Real Estate on such date.

  • In consultation with the Borrower, the Agent has identified the Initially Selected Real Estate and the items that will comprise the Real Property Documentation related thereto has been or shall be obtained and furnished to the Agent for its review as soon as reasonably possible.

  • The rights and obligations of the Parties as the Co-Owners of the Real Property are dealt with in the Co-Owners Regulations (Stockwerkeigentümer-Reglement) which forms part of the Real Property Documentation.

More Definitions of Real Property Documentation

Real Property Documentation means the following as to each parcel of the Real Properties, in each case in form and substance satisfactory to the Required Holders in their reasonable judgment:
Real Property Documentation means the instruments, documents and agreements executed and/or delivered by Borrower or any Guarantor to the Collateral Agent (if applicable) pursuant to Section 6.27(b) in connection with each Mortgage in order to convey to the Collateral Agent (or a trustee for the benefit of the Administrative Agent, as applicable under the applicable law) for the equal and ratable benefit of the Secured Parties (except that the benefit of the Liens of the Collateral Agent in all of the Collateral as to the Junior Synthetic Lease Secured Obligations is junior and subordinate to the benefit of such Liens as to the other Secured Obligations), a first priority security interest in, lien on and security title (subject to Permitted Encumbrances) to the right, title and interest of the Borrower and each Guarantor in the Designated Real Property described therein, and other rights ancillary thereto, all in form and substance reasonably satisfactory to the Collateral Agent, after consultation with the Borrower. The Real Property Documentation shall include, without limitation, the following as to each Designated Real Property and the land on which it is located:
Real Property Documentation means the instruments, documents and agreements executed and/or delivered by Borrower or any Guarantor to the Collateral Agent (if applicable) pursuant to Section 5.26(b) in connection with each Mortgage in order to convey to the Collateral Agent (or a trustee for the benefit of the Collateral Agent, as applicable under the applicable law) for the equal and ratable benefit of the Secured Parties, a first priority security interest in, lien on and security title (subject to Permitted Encumbrances) to the right, title and interest of the Borrower and each Guarantor in the Designated Real Property described therein, and other rights ancillary thereto, all in form and substance reasonably satisfactory to the Collateral Agent, after consultation with the Borrower, including as to the establishment of reasonable estimated values of the Designated Real Property for purposes of title insurance coverage and stamp and similar recording taxes. The Real Property Documentation shall include, without limitation, the following as to each Designated Real Property and the land on which it is located:
Real Property Documentation means the instruments, documents and agreements executed and/or delivered by Borrower to the Administrative Agent (if applicable) pursuant to Section 5.25 in connection with each Mortgage in order to convey to the Administrative Agent (or a trustee for the benefit of the Administrative Agent, as applicable under the applicable law) for the equal and ratable benefit of the Banks and Senior Note Holders, a first priority security interest in, lien on and security title (subject to Permitted Encumbrances) to the right, title and interest of the Borrower and each Guarantor in the Plant or Plants or Designated Other Real Property described therein, and other rights ancillary thereto, all in form and substance reasonably satisfactory to the Administrative Agent, after consultation with the
Real Property Documentation means the following as to each parcel of the Real Properties, in each case in form and substance satisfactory to the Required Lenders in their reasonable judgment:
Real Property Documentation shall include the Real Property Deed, the Co-Owners Regulations, and the parcelling of the original property.
Real Property Documentation means the following as to each parcel of the Real Estate (except that the Agent may in its discretion waive or suspend the requirement for delivery of certain of the Real Property Documentation for any of the Real Estate, other than, unless directed by the Required Lenders, one or more Mortgages);
