Release Premises definition

Release Premises shall have the meaning assigned to such term in Section 1.1(a).

Release Premises. All those certain portions of the Building identified on Exhibit X-x hereto as being “Release Premises”, subject to deletions from the Release Premises pursuant to Section 1.7 (by virtue of either Tenant electing to add all or any portion of the Release Premises to the Leased Premises pursuant to Section 1.7(c) or Tenant electing to surrender any portion of the Release Premises prior to the end of the Preliminary Period pursuant to Section 1.7(d)(1) hereof). Each time there is a deletion from the Release Premises as herein provided, Landlord and Tenant, within thirty (30) days thereafter, shall execute and deliver a written instrument confirming the same, which instrument shall (x) set forth the then Net Rentable Area of the Release Premises and Tenant’s Occupancy Percentage, and (y) be accompanied by a revised Exhibit B-1 hereto showing the then location and configuration of the Release Premises. Release Premises means any of the Granite City Premises, Kendallville Premises, and Upper Sandusky Premises.

Examples of Release Premises in a sentence

• If, as of the date that is thirty (30) days after Release Premises Election Date, any Coterminous Former Release Premises has not been designated by Tenant as either Type A Coterminous Former Release Premises or Type B Coterminous Former Release Premises, then such theretofore undesignated Coterminous Former Release Premises shall be deemed designated as Type A Coterminous Former Release Premises.

• Tenant may designate some portions of any Coterminous Former Release Premises as Type A Coterminous Former Release Premises and other portions thereof as Type B Coterminous Former Release Premises.

• Tenant shall be permitted to make different elections with respect to different portions of the Release Premises.

• If Tenant fails to notify Landlord of its election with respect to any portion of the Release Premises prior to the expiration of the Release Premises Election Date, then Tenant shall be deemed to have elected to surrender such portion of the Release Premises not later than the expiration of the Preliminary Period.

• Commencing on the Closing Date, Purchaser, as landlord, shall lease to Seller, as tenant, the Leased Premises and the Release Premises at each Property conveyed on the Closing Date (and which contains either Leased Premises or Release Premises) by separate lease agreements in the form set forth on Exhibit P hereto (each, a “Lease Agreement” and, collectively, the “Lease Agreements”).

Release Premises means the Bluffton Premises.

Release Premises means all those certain portions of the Buildings that do not constitute part of the Leased Premises, but which will be occupied by Tenant or Tenant's personal property on the Closing Date, including the Occupied Release Premises and the Unoccupied Release Premises.

Release Premises shall have the meaning assigned to such term in Section 1.1(a) and include the Occupied Release Premises and the Unoccupied Release Premises.

Release Premises means, for certain Properties subject to Lease Agreements, certain premises demised under the Lease Agreements which Seller, as tenant, may ultimately surrender to Purchaser, as landlord, in accordance with the provisions of the Lease Agreements. The Property Information Schedule contains an estimate of the Net Rentable Area of the Release Premises at those Properties which contain the same. The precise Net Rentable Area, and location of, the Release Premises at such Properties shall be determined through the measurement process contemplated by Section 27 hereof.
