Renegotiation of Agreement. Either party to this Agreement may, within ninety (90) days prior to termination of this Agreement, present to the other party in writing proposed terms of a new or further Agreement and/or amendments to this Agreement, and a conference shall be held within twenty (20) days, or as otherwise agreed by the parties, at which time the parties will commence negotiations on the proposed amendments and/or terms of a new Agreement. Negotiations will be conducted in the spirit of good faith.
Renegotiation of Agreement. (a) A relative custodian or adoptive parent of a child with a Northstar kinship assistance or adoption assistance agreement may request renegotiation of the agreement when there is a change in the needs of the child or in the family's circumstances. When a relative custodian or adoptive parent requests renegotiation of the agreement, a reassessment of the child must be completed consistent with section 256N.24, subdivisions 10 and 11. If the reassessment indicates that the child's level has changed, the financially responsible agency or, if there is no financially responsible agency, the agency designated by the commissioner or the commissioner's designee, and the caregiver must renegotiate the agreement to include a payment with the level determined through the reassessment process. The agreement must not be renegotiated unless the commissioner, the financially responsible agency, and the caregiver mutually agree to the changes. The effective date of any renegotiated agreement must be determined by the commissioner.
(b) An adoptive parent of an at-risk child with an adoption assistance agreement may request renegotiation of the agreement to include a monthly payment under section 256N.26 if the caregiver has written documentation from a qualified expert that the potential disability upon which eligibility for the agreement was based has manifested itself. Documentation of the disability must be limited to evidence deemed appropriate by the commissioner. Prior to renegotiating the agreement, a reassessment of the child must be conducted as outlined in section 256N.24, subdivision 10. The reassessment must be used to renegotiate the agreement to include an appropriate monthly payment. The agreement must not be renegotiated unless the commissioner, the financially responsible agency, and the caregiver mutually agree to the changes. The effective date of any renegotiated agreement must be determined by the commissioner.
(c) Renegotiation of a Northstar kinship assistance or adoption assistance agreement is required when one of the circumstances outlined in section 256N.26, subdivision 13, occurs.
Renegotiation of Agreement. This Agreement may be reopened at any time during its effective term by mutual consent of both parties. All requests for renegotiations or conferences shall be in writing with specified items proposed for consideration.
Renegotiation of Agreement. Negotiations for a new agreement will commence three (3) months prior to the nominal expiry date of this Agreement.
Renegotiation of Agreement. The parties agree to commence negotiations for the next Agreement six months before the expiration of this Agreement.
Renegotiation of Agreement. 2.2.1 The parties agree to commence negotiations for a new enterprise agreement to succeed this Agreement at least 4 months before the nominal expiry date of this Agreement.
Renegotiation of Agreement. In the event of renegotiation of this Agreement, such negotiations shall begin no later than sixty (60) days after receipt of the above Notice.
Renegotiation of Agreement. The Parties will commence negotiations for a replacement agreement no later than 31 March 2028.
Renegotiation of Agreement. 11.1. It is Agreed that the Parties Will Commence the Process of Renegotiation of a New Agreement Up to Four Months Prior to the Date of Expiry of This Agreement.
Renegotiation of Agreement. 65.1. The Company, employees and the Union (“the parties”) agree to commence negotiations for a new Enterprise Agreement to succeed this Agreement at least 3 months before the nominal expiry date of this Agreement. The parties intend to conclude these negotiations prior to the nominal expiry date.
65.2. These negotiations will be conducted on a collective basis between the parties with the negotiated outcome being collectively approved.
65.3. The parties agree to bargain collectively in relation to any matters whether arising from this Agreement or not including the renewal, extension, variation or renegotiation of this Agreement.
65.4. Should negotiations for a new Enterprise Agreement not be finalised prior to the nominal expiry date of this Agreement, the rates of pay and conditions prescribed by this Agreement will continue to be observed for all employees by the Company.
