Accordingly, to the extent that any rights and claims are assigned by the Issuer to the Security Trustee for security purposes in accordance with clause 5 (Assignment for Security Purposes), in insolvency proceedings on the Security Trustee's estate, such rights would be segregated (Aussonderungsrecht) as assets of the Issuer held in trust.
Any liberty or right which may be exercised or any determination which may be made under this Agreement by the Security Trustee may be exercised or made in the Security Trustee's absolute discretion without any obligation to give reasons therefor and the Security Trustee shall not be responsible for any liability occasioned by so acting but subject always to the terms of the Deed of Charge.

Lender shall not have any independent power to enforce, or have recourse to, any of the Charged Property or to exercise any rights or powers pursuant to the Security Documents except through the Security Trustees.
