Segment A definition

Segment A means the portion of the System containing the Shima Cable Station and the four fiber pair facility from Shima, Japan to Branching Unit 1.

Segment A means the four fiber pair Segment of the System from the St. Croix (SAC) Cable Station to Fortaleza, Brazil and landing in Fortaleza in a location capable of interconnecting with major telecommunications carriers.

• The main product groups in the Group Annuity product line used in the calculation of the ACs include: Group Annuity Segment business ("GAS"), Defined Contribution business ("DC"), Group Pension Segment A business ("GPSA"), Prupar business, Separate Account Investment Only business, Separate Account GIC business, and Synthetic GIC business.

• On the Effective Date, the total estimated cost of the Pathnet Items with respect to Segment A is [***] (the "Segment A Pathnet Estimated Costs"), and with respect to Segment B is [***] (the "Segment B Pathnet Estimated Costs").

• PathNet shall provide all reasonable efforts to construct Segments A and B within seven (7) months from the time all permits and approvals have been received; PROVIDED, HOWEVER, PathNet shall complete the installation and construction of Segment A by no later than December 31, 1997 and Segment B by no later than the date of commencement of pipeline commercial operations.

• TC-3 may designate, at its sole discretion, any Person for the purpose of invoicing or receiving payment of all costs charged to the Grantee hereunder (including the Granting Price and the Segment A Price).
