Site Remediation Measures definition

Site Remediation Measures means any efforts of any foreign, federal, state or local government, or a party, their contractors, subcontractors, or agents, that are made, designed, initiated, or maintained as required by Environmental Laws or Commitments entered into by a party in order to ensure that Environmental Conditions are consistent with Environmental Laws or Commitments entered into by a party, including, site investigation, site monitoring, containment, clean-up, transport, removal, disposal, restoration and other remedial efforts of any kind. (b)
Site Remediation Measures means all actions required to assess, investigate, contain, treat, monitor, clean-up, remove, remediate or in any other way address Environmental Conditions at the Property and render the Property compliant with applicable Environmental Laws, including, but not limited to the RSRs, to the extent the RSRs are applicable to such Environmental Conditions.
Site Remediation Measures means (i) for State Property efforts of Developer, or its Project Providers or agents, which are made, designed, initiated, or maintained to ensure that Environmental Conditions comply with Environmental Laws, including the Transfer Act and the Remediation Standard Regulations as applicable, and may include, without limitation, investigation, site monitoring, containment, clean-up, transport, removal, disposal, restoration and other remedial efforts of any kind; and (ii) for Developer Property, efforts of Developer, or its Project Providers or agents, which are made, designed, initiated, or maintained to ensure that Environmental Conditions comply with Environmental Laws, including the Transfer Act and the Remediation Standard Regulations as applicable (and where RSR compliance is not specifically required by law, by way of example, non-Transfer Act parcels, Site Remediation Measures are implemented consistent with the remediation criteria established by the RSRs in the sole discretion of an LEP retained by CTDOT), and may include, without limitation, investigation, site monitoring, containment, clean-up, transport, removal, disposal, restoration and other remedial efforts of any kind.

Examples of Site Remediation Measures in a sentence

  • Until a Compliance Completion Event has occurred, Purchaser shall provide to Seller on a quarterly basis, on the last business day of each calendar quarter, a report describing the status of Site Remediation Measures completed as of such date and identifying the aggregate Investigation and Compliance Costs incurred as of such date, in such reasonable detail as the parties shall agree.

  • Such compliance shall include, but not be limited to, preparing and implementing Site Remediation Measures as may be required.

  • The parties agree that the Purchase Price and other conditions of this Agreement were established based upon the understanding that Purchaser will assume full responsibility for all Environmental Conditions at the Property, including the PCB Conditions, as of the Closing Date, and that Purchaser will diligently and in a timely manner complete the Site Remediation Measures to effect a Compliance Completion Event.

  • Merger Sub shall pay all initial and subsequent fees associated with the Transfer Act and perform any Site Remediation Measures as may be required at the Premises under the Act in a manner and to standards which are acceptable to the State of Connecticut Department of Energy and Environmental Protection.

  • Accordingly, from and after Closing, Purchaser shall assume all liabilities, duties and responsibilities imposed by or arising under applicable Environmental Laws with respect to the Property, including, but not limited to, (i) formally assuming responsibility to DEEP for compliance with and closure of the NOV and SEH Notification, and (ii) implementing the Site Remediation Measures.

  • Purchaser shall promptly commence and diligently perform the Site Remediation Measures and any other obligations required by DEEP and/or EPA with respect to the Environmental Conditions, and shall be solely responsible for and pay all Investigation and Compliance Costs.

  • Buyer shall thereafter pay all fees and perform any Site Remediation Measures, as may be required at the applicable premises in a manner and to standards which are acceptable to the State of Connecticut Department of Environmental Protection.

  • Such compliance shall include, but not be limited to, implementing Site Remediation Measures.

Related to Site Remediation Measures

  • Licensed site remediation professional means an individual who is licensed by the Site Remediation Professional Licensing Board pursuant to section 7 of P.L.2009, c.60 (C.58:10C-7) or the department pursuant to section 12 of P.L.2009, c.60 (C.58:10C-12).

  • Mitigation Measures means “mitigation measures” as defined in subsection 2(1) of the Canadian Environmental Assessment Act, 2012.

  • Remediation waste management site means a facility where an owner or operator is or will be treating, storing or disposing of hazardous remediation wastes. A remediation waste management site is not a facility that is subject to corrective action under § 264.101 of this regulation, but is subject to corrective action requirements if the site is located in such a facility.

  • Technology protection measure means a specific technology that blocks or filters Internet access to visual depictions that are:

  • Remediation waste means all solid and hazardous wastes, and all media (including groundwater, surface water, soils, and sediments) and debris that are managed for implementing cleanup.

  • Fluoroscopic imaging assembly means a subsystem in which X-ray photons produce a visual image. It includes the image receptor(s) such as the image intensifier and spot-film device, electrical interlocks, if any, and structural material providing linkage between the image receptor and diagnostic source assembly.

  • Environmental and Social Impact Assessment or “ESIA” means a site-specific report, to be prepared in accordance with the parameters laid down in the ESMF (as hereinafter defined) and acceptable to the Association, identifying and assessing the potential environmental and social impacts of the activities to be undertaken for the Project, evaluating alternatives, and designing appropriate mitigation, management, and monitoring measures.

  • Decontamination means a process that attempts to remove or reduce to an acceptable level a contaminant exceeding an allowable threshold set forth in these Rules in a harvest batch or production batch.

  • Corrective Maintenance means the maintenance which is required when an item has failed or worn out, to bring it back to working order, which may also include those services necessary to partially restore, renew or strengthen an existing Department facility or system, following damage caused by use or normal wear and tear.

  • COVID-19 Measures means any quarantine, “shelter in place”, “stay at home”, workforce reduction, social distancing, shut down, closure or sequester order, guideline, recommendation or Law, or any other applicable Laws, guidelines or recommendations by any Governmental Entity in connection with or in response to COVID-19.

  • Remedial Action means all actions taken to (a) clean up, remove, remediate, contain, treat, monitor, assess, evaluate, or in any way address Hazardous Materials in the indoor or outdoor environment, (b) prevent or minimize a release or threatened release of Hazardous Materials so they do not migrate or endanger or threaten to endanger public health or welfare or the indoor or outdoor environment, (c) restore or reclaim natural resources or the environment, (d) perform any pre-remedial studies, investigations, or post-remedial operation and maintenance activities, or (e) conduct any other actions with respect to Hazardous Materials required by Environmental Laws.

  • Invasive species means an alien species whose introduction does or is likely to cause economic or environmental harm or harm to human health.

  • Construction and demolition waste means the waste building materials, packaging, and rubble resulting from construction, remodeling, repair, and demolition operations on pavements, houses, commercial buildings and other structures.
