Stormwater Associated with Industrial Activity definition

Stormwater Associated with Industrial Activity means the discharge from any conveyance which is used for collecting and conveying stormwater and which is directly related to manufacturing, processing or raw materials storage areas at an industrial plant. The term does not include discharges from facilities or activities excluded from the NPDES program. For the categories of industries identified in subparagraphs (i) through (xi) of this definition, the term includes, but is not limited to, stormwater discharges from industrial plant yards; immediate access roads and rail lines used or traveled by carriers of raw materials, manufactured products, waste material, or by-products used or created by the facility; material handling sites; refuse sites; sites used for the application or disposal of process waste waters (as defined at 40 CFR 401); sites used for the storage and maintenance of material handling equipment; sites used for residual treatment, storage, or disposal; shipping and receiving areas; manufacturing buildings; storage areas (including tank farms) for raw materials, and intermediate and finished products; and areas where industrial activity has taken place in the past and significant materials remain and are exposed to stormwater. For the purposes of this paragraph, material handling activities include the storage, loading and unloading, transportation, or conveyance of any raw material, intermediate product, finished product, by-product, or waste product. The term excludes areas located on plant lands separate from the plant's industrial activities, such as office buildings and accompanying parking lots as long as the drainage from the excluded areas is not mixed with stormwater drained from the above described, regulated areas. Industrial facilities (including industrial facilities that are Federally, State or municipally owned or operated that meet the description of the facilities listed in paragraphs (i) - (xi)) include those facilities designated under 122.26(a)(1)(v). The following categories of facilities are considered to be engaging in "industrial activity" for purposes of this subsection:

Industrial facilities (including industrial facilities that are federally or municipally owned or operated that meet the description of the facilities listed in this paragraph (i)-(xi)) include those facilities designated under 122.26(a)(1)(v). The following categories of facilities are considered to be engaging in “industrial activity” for purposes of this subsection:

• Loading and unloading shall be done in a manner that will not produce stormwater contamination and runoff, consistent with requirements of The General Permit for Discharges of Stormwater Associated with Industrial Activity.

• Coverage under Maryland’s NPDES General Permit for Discharges of Stormwater Associated with Industrial Activity (SW Industrial GP) is typically required at facilities where the following activities are performed: maintenance or storage of vehicles or equipment; storage of fertilizers, pesticides, landscaping materials, hazardous materials, or other materials that could pollute stormwater runoff.

• Regulated stormwater discharges consist of those authorized under the General Permit for the Discharge of Stormwater from Municipal Separate Storm Sewer Systems (MS4 GP), General Permit for the Discharge of Stormwater and Dewatering Wastewaters from Construction Activities (Construction GP), General Permit for the Discharge of Stormwater Associated with Industrial Activity (Industrial GP), and General Permit for the Discharge of Stormwater from Commercial Activities (Commercial GP).

• Certain establishments which discharge sediment laden stormwater and fall under the definition of "Stormwater Associated with Industrial Activity" can elect to be regulated under the General Permit.

• Stormwater Associated with Industrial Activity means the discharge from any conveyance that is used for collecting and conveying stormwater and which is directly related to manufacturing, processing or raw materials storage areas at an industrial plant.

• The stormwater discharge resulting from an activity classified by the Standard Industrial Classification 10 and 12 through 14 (the mining industry) is not eligible to be authorized by this general permit and is regulated under the most recently issued General Permit for the Discharge of Stormwater Associated with Industrial Activity.

• Stormwater from the Facility was covered by the EPA Multi-Sector General Permit for Stormwater Associated with Industrial Activity (MSGP) issued in 2008, however PCC Structurals did not reapply for coverage when the MSGP was reissued in 2015.

• Monitoring Requirements for Stormwater Associated with Industrial Activity For purposes of this general permit, a qualifying storm event is an event that results in a discharge from the permitted facility.
