Subordinated Security Documents definition

Subordinated Security Documents means the “Security Documents” as defined in the Subordinated Debenture Purchase Agreement and the “Security Documents” as defined in the Indenture.

Subordinated Security Documents the collective reference to the documents listed on Schedule 1 hereto, as the same may be amended, modified or otherwise supplemented from time to time with the prior written consent of the Senior Lender and any other documents executed by the Debtors with the prior written consent of the Senior Lender that from time to time secure payment or performance of the Subordinated Obligations.

Subordinated Security Documents the collective reference to any and all documents providing for collateral security, guarantees or negative pledges in connection with the notes issued under the Indenture as the same may be amended, supplemented or otherwise modified from time to time in accordance with Section 6.9 of the BIPCO Credit Agreement.

Examples of Subordinated Security Documents in a sentence

• Subordinated Security Documents means any Security Documents securing Subordinate Debt.

• The Offtaker shall not amend, supplement or otherwise modify, without the consent of the Senior Agent, the terms of any of its Subordinated Security Documents, or enter into any other agreement having the effect of doing so in a manner that would adversely affect the rights of the Senior Agent pursuant to this Agreement.

• The Offtaker confirms that it has delivered to the Senior Agent true and correct copies of the Subordinated Security Documents, in each case as in effect on the date hereof, and all UCC financing statements and other filings to perfect its security interest in the Senior Collateral.

• Offtaker may also, without the consent of the Senior Agent, amend, supplement or otherwise modify the Subordinated Security Documents to correct any technical errors or omissions contained therein which are also corrected in the Senior Credit Documents.

• The consent by the Senior Lenders to the execution and delivery of the Subordinated Security Documents and the grant to the Offtaker of a Lien in the Senior Collateral shall be deemed to have been made in reliance upon this Agreement.

More Definitions of Subordinated Security Documents

Subordinated Security Documents means each and all of the mortgages, security agreements, pledges, assignments and other documents and instruments at any time securing any of the Subordinated Obligations, subject, however, to Lender’s consent in accordance with Section 2(d) of this Agreement.

Subordinated Security Documents means any Security Documents inferior in priority to the most senior Security Documents and to first tier subordinate Security Documents securing mezzanine financing, and generally includes any sub-debt held by Affiliates or other equity investors in Developer.

Subordinated Security Documents means the documents specified in Schedule 3.

Subordinated Security Documents the collective reference to ------------------------------- any and all documents providing for the pledge of the capital stock or other equity interests of each Pledged Subsidiary and the property related thereto as collateral security in connection with the Indenture and the Subordinated Notes issued under the Indenture.
