System Performance Requirements definition

System Performance Requirements has the meaning set forth in the System Description section of the Technical Volume.
System Performance Requirements means with respect to a Segment or the System, the applicable performance requirements set forth or to be developed by mutual written agreement of the Parties (and, with respect to those performance requirements to be mutually developed by the Parties, as accepted and approved by the Independent Engineer, which acceptance and approval shall not be unreasonably withheld) pursuant to the System Performance section of the System Description section of Appendix 4 (or pursuant to Article 33 in the absence of such mutual agreement).

More Definitions of System Performance Requirements

System Performance Requirements shall have the meaning specified in Section 2.2 (Definitions) of Exhibit D (Service Level Agreement).

UPGRADE BILLING SCHEDULE means the billing schedule attached hereto as Appendix 1 in the Draw Schedule. WARRANTY PERIOD has the meaning set forth in Article 10(A).
System Performance Requirements means the requirements for System Performance, including Paragraph 5.3 (System Performance Requirements) of this SLA.
