Availability Requirements. (a) All employees must be available to work the designated Servomation Major Events as a condition of continued employment unless appropriate leave is granted or extenuating circumstances arise. (b) Employees will inform the Employer of their availability on the 15th day of each month, for the following month, except employees may submit availability for a maximum of the next three (3) consecutive months, in which case employees will inform the Employer of their availability on the 15th day of the last month for which they have provided an availability, for the following month(s). If the 15th falls on a Saturday, Sunday or statutory holiday, availability will be given on the first working day immediately following the 15th. Availability will be given on a designated form to be supplied by the Employer. This form must be filled out by the employee and submitted by mail or FAX by the 15th, if submitted by mail, post marked by the 15th. (c) Availability will be considered current unless notice is given by an employee no less than two (2) weeks prior to the scheduling week that would be affected. Any change given with less than two (2) weeks' notice shall not be accepted. (d) Any employee who does not indicate availability for a period of thirty (30) days will be sent a registered letter by the Employer requesting information about availability. The Employee must respond to this letter within five (5) days excluding weekends and holidays. Failure to respond in a timely manner may be grounds for termination.

Availability Requirements. Notwithstanding anything to the contrary contained herein, if Availability (without giving effect to any other adjustment or threshold, including, without limitation, the requirements of Section 7.03(c)) would be less than $10,000,000 immediately after giving effect to any prepayment of the B-Loans pursuant to Section 2.05(d)(ii), Section 2.05(d)(iii), Section 2.05(d)(iv) or Section 2.05(d)(v), no such prepayment of the B-Loans shall be made and such amounts shall be applied to the repayment of the Revolving A Loans. Concurrently with such repayment of the Revolving A Loans, the Administrative Agent shall establish and maintain a corresponding reserve against both the Borrowing Base and the Total Revolving A Credit Commitment in an amount equal to the amount that would have otherwise been applied as a prepayment of the B-Loans, and the B-Loans may be prepaid by such amount at such time and from time to time if no Event of Default would exist and Availability (calculated without giving effect to these reserves or any other adjustment or threshold, including, without limitation, the requirements of Section 7.03(c)) would exceed $10,000,000 immediately after giving effect to such prepayment of the B-Loan by such amount and the corresponding reserve established pursuant to the first sentence of this Section 2.05(f) against both the Borrowing Base and the Total Revolving A Credit Commitment shall be released in an amount equal to such prepayment at such time and from time to time as each such prepayment is made.

(b) On or before the 1st of each month, the Employer will have availability forms at the BC Place Centerplate staffing office for pick up by the employees. The Employer will also email availability forms if the employee has requested and has provided the Employer with a valid email address. The availability form will designate both the Major and Non-Major events, set ups and move-ins for the following month (for example: availability forms for the month of February will be available January 1). (c) By the 10th day of the month, the employee must return the availability form confirming his/her agreement to work the mandatory Major Events and to xxxx which of the Non-Major events that he/she is available to work. (d) If the 10th day falls on a Saturday, Sunday or statutory holiday, the availability form will be handed in on the first working day immediately following the 10th. (e) An employee may submit the availability form in person, by fax, by email or by mail. If the form is submitted by mail, it must be post-marked on or before the 8th of the month. (f) All employees must be available to work the designated Major Events in each month, except where a leave of absence has been granted prior to the event as per Article 21.6 or the sick leave provisions of Article 21.8 apply or the employee can show there were extenuating circumstances that warrant a leave of absence. (g) An employee who does not provide the Employer with their monthly availability from by the 10th day of the month will be considered unavailable to work the Non-Major Events of that month. If such employees are called into work an event the calls will be made by classification seniority and qualifications. (h) Employees who do not return the monthly availability form for two consecutive months will be considered to have voluntarily terminated their employment unless he/she has worked a Major or Non-Major Event during that two consecutive month period.
Availability Requirements. 1.7.1 The Government will deliver the vessel from PSNS/IMF Bremerton, WA to the Contractors facility. Upon completion of all work, the Government will take custody of vessel at the contractor’s facility. Contractor shall provide all materials, labor, and insurance bonds necessary for the period that the vessel is located at the Contractor’s repair facility. 1.7.2 Provide quantity 7 heated/air conditioned office space measuring a minimum of 160 square feet and located within 1/4 mile of the vessel from 2 days prior to project start to 2 days after project completion for use by the COR. 1.7.2.1 The office spaces shall be equivalent to Satellite model 820MO, 8 feet X 20 feet interior size, with lockable doors and platform with stairs. 1.7.2.2 The offices space shall be lockable, secure, and safe for personnel and equipment. 1.7.2.3 Provide quantity 2 each keys for all doors and quantity 2 each master keys to fit all locks to the SOW COR. 1.7.2.4 Furnish quantity One each work station in each office with the following at each work station: 1.7.2.4.1 Quantity (One EA) duplex 110 volt receptacle. 1.7.2.4.2 Quantity (One EA) desk, 30 inches wide x 48 inches in length, with chair. Chair shall be adjustable in height, with swivel and adjustable arm rests. 1.7.2.4.3 Quantity (One EA) CAT-5 cable connection at 35 MBPS minimum download speed for a COR supplied desktop/laptop computer. This connection shall be separate from Contractor’s computer servers/networks 1.7.2.4.4 Quantity (One EA) trash can. 1.7.2.5 Provide a single network printer on the same network as connections in paragraph 1.7.2.4.3 for 1.7.2. 1.7.2.6 Provide designated Quantity 7 EA parking space adjacent to the office spaces of 1.7.2 for the entire contract period. 1.7.2.7 Provide Restroom (Quantity 2 EA) within 250 feet of office spaces of 1.7.2 both male and female unless unisex. 1.7.3 Provide electrical service equipment capable of supplying, 440 volt, 60 Hz, 3 phase, 100 amp electrical service to the vessel for the availability. Connect the electrical service equipment via the vessels shore power receptacle using a Xxxxxxx C4100C7W female connector or equal after the new switchboard has been installed and tested in paragraph 3.13 Shipalt 0053D.
