Third Party Facilities definition

Third Party Facilities means the facilities, including but not limited to telecommunication and information network facilities and colocation facilities, owned and/or operated by third parties over which all or a portion of the Services may be provided under this Agreement. "Transmission Problem" for any Service shall have the meaning set forth in the Product Supplement for such Service.
Third Party Facilities means the functionality by which the Services (or any part of them) are made available to third parties for personal use and accessed by use of a PIN issued by You to the third party including but not limited to Horizon;
Third Party Facilities means telephone facilities, infrastructure and other property of Utility Companies and Railway Companies and other public facilities and associated equipment, plant, materials and apparatus installed and operated or to be installed and operated on the Lands by any transit authority, communications provider, Utility Company, Railway Company or other third party (not including, for the avoidance of doubt, DB Co or any DB Co Party).

Examples of Third Party Facilities in a sentence

  • With respect to any Services provided in whole or in part on Third Party Facilities, any rights of Buyer to defer the Scheduled Service Date and any associated charges shall be determined by Seller on an individual case basis.

  • Notwithstanding the foregoing, in the event of an emergency, Seller will have the right to perform maintenance and/or restoration of its facilities or Third Party Facilities (including, without limitation, actions required to restore continuity to a severed or partially severed fiber optic cable, restore dysfunctional power and ancillary support equipment, or correction of any potential jeopardy conditions), and Seller will notify Buyer as soon as reasonably practicable thereafter.

  • Seller will provide Buyer as much advance notice as reasonably practicable with regard to any scheduled maintenance performed on any Third Party Facilities that provides Services under this Agreement.

  • Our liability for any Loss suffered or incurred by you under or in connection with our provision of Services to you (whether based in contract, tort (including negligence), statute or otherwise) is reduced to the extent that your or your Personnel’s acts or omissions or the use of any Third Party Facilities used in connection with our Services, or the acts, omissions or equipment of a third person, caused or contributed to that Loss.

  • Lastly, no Service Outage Credits will apply for Services utilizing in whole or in part Third Party Facilities, or an instance in which Customer’s and/or its users’ usage of or demand with respect to the Service is oversubscribed.


More Definitions of Third Party Facilities

Third Party Facilities means premises owned, leased or sub-leased by a Third Party and used in the creation of the IP.
Third Party Facilities means fiber optic cable and associated equipment not owned or within the immediate control of FiberLight, LLC.

Third Party Facilities means all plants, mills and other facilities (including all real properxx xx which such facilities are situated), containers, vehicles, rail cars, motor vessels, trailers, storage or holding tanks and other machinery and equipment owned, leased, managed, controlled or operated by any agent of any Gerdau Canada Group Member or any third party contracting with any Gerdau Canada Group Member in which inventory, Hazardous Materials or Waste owned, managed or controlled by any Gerdau Canada Group Member is manufactured, processed, generated, received, stored, treated, transported, otherwise handled or disposed of;
Third Party Facilities means equipment and other transmission apparatus necessary for the proper operation of a telecommunications system that is not owned by Grantee, but for which Grantee is responsible for the installation and maintenance of such equipment. Third Party Facilities may include, but is not limited to, canister-style antennas, panel-style antennas, Micro Remote Radio Unit radios (“MRRUs”) and Remote Radio Unit radios (“RRUs”). The Parties agree and understand that this list is not exhaustive and other antennas or radio units may be needed to provide service for the small cell network. In the event that other equipment is needed, the Parties will work together to either amend this Agreement and/or prepare other documentation that will allow for the inclusion of such equipment.
Third Party Facilities means transit shelters, telephone facilities, Infrastructure and other property of Utility Companies and other public facilities and associated equipment, plant, materials and apparatus installed and operated or to be installed and operated on the Lands by any transit authority, communications provider, Utility Company, or other third party (not including, for the avoidance of doubt, Project Co or any Project Co Party).
