Third Party Software/Open Source. Nothing in this Agreement shall restrict, limit or otherwise affect any rights or obligations You may have, or conditions to which You may be subject, under any applicable open source licenses to any open source code contained in the Software. The Software may include or be bundled with other software programs licensed under different terms and/or licensed by a licensor other than Licensor. Use of any software programs accompanied by a separate license agreement is governed by that separate license agreement. Any third party software that may be provided with the Software is included for use at Your option.
Third Party Software/Open Source. Certain components of the Software may incorporate open-source software (“OSS”) or third-party software (collectively, “Third-Party Software”). To the extent required by the licenses covering the same, the terms of such third-party licenses will govern solely with respect to such Third-Party Software. To the extent the licenses applicable to OSS (i) prohibit any restriction in this Agreement with respect to such OSS, such restriction will not apply to such OSS; and (ii) require Honeywell to make an offer to provide source code or related information in connection with the OSS, such offer is hereby made. You acknowledge receipt of notices for OSS. All Third-Party Software is provided on an “as-is” basis, and Honeywell makes no express or implied warranties of any kind with respect thereto and assumes no liability for any damages regarding the use or operation of any such Third-Party Software.
Third Party Software/Open Source. Any Open Source Software that may be delivered by Big Easy Software embedded in or in association with Big Easy Software products is provided pursuant to the open source license applicable to the software.
Third Party Software/Open Source. The Software may contain software provided by third parties, and such third parties' software is provided “As Is” without any warranty of any kind, and subject to the license terms attached to such third party software, the provisions of this Agreement shall apply to all such third party software providers and third party software as if they were Aquarius and the Software respectively.
Third Party Software/Open Source. The Software contains proprietary software provided by third parties as well as certain open source software components. Third party proprietary software is provided "AS IS" without warranty of any kind, and subject to the the applicable license terms attached to such third party software and if no such terms are attached then, such software is licensed under the terms of this license and accordingly, the restrictions contained in this License Agreement shall apply to such third party proprietary software providers and third party proprietary software as if they were Trustifi and the software respectively.
Third Party Software/Open Source. The Luci Service may contain open source and other third party software which may be covered by a different license. All third party software is and will remain subject to the terms and conditions under which it is provided, and You are responsible for compliance with such terms.
Third Party Software/Open Source. All Open Source Software (also referred to as OSS) may be included in, embedded in, used by, provided or distributed with a Service. Any such OSS is licensed to you by the copyright holder of the OSS under the license terms applicable to that OSS and is not licensed to you by Avail under the terms of this XXXX. To the extent Avail is required (a) make certain disclosures regarding such Open Source Software; (b) make available to you any source code or modifications to the Open Source Software Customer may request such information; and/or (c) to make available to you any source code or modifications to the Open Source Software, you may obtain this information by sending a written request, with Customer's name and address to: Avail Medsystems, Inc., Attention: Legal Department, Open Source Files Request, (“Avail Address”). Third party owned software or services used in the Streaming Service are subject to the terms and conditions of this XXXX except where specifically indicated in which case additional terms and conditions may also apply to the third party software or services in which case such terms will be set forth herein. Third Party Software/Open Source. Licensee acknowledges that portions of the Software may include third party open source software modules that are subject to third party terms and conditions ("Third Party Terms"). If there is a conflict between any Third Party Terms and the terms of this Agreement, then the Third Party Terms shall prevail, but solely in connection with the related third party open source software. Notwithstanding anything in this Agreement to the contrary, Nyotron makes no warranty with respect to any third party open source software.
