Tier IV definition

Tier IV means the juvenile’s most serious committing offense is a felony offense punishable for twenty (20) or more years of confinement if the offense were committed by an adult. These offenses are enumerated in Appendix B. This is the most serious of the LOS most serious committing offense designation.
Tier IV means that the Total Debt to Capitalization Ratio is greater than or equal to 0.25 to 1.00. Each change in the Applicable Percentage shall be effective upon receipt by the Administrative Agent of the certificate delivered pursuant to Section 5.4(c); it being understood that if such certificate is not delivered when due, the Applicable Percentage shall be deemed to be Tier IV during the period from the date such certificate is required to be furnished until such time that such certificate is furnished.
Tier IV means that the Senior Unsecured Debt Rating of the Borrower is not at the Tier I, Tier II or Tier III level, and is at least either (a) BBB+ by S&P or (b) Baa1 by Mxxxx’x.

More Definitions of Tier IV

Tier IV. Tier V" and "Tier VI" set forth in Section 1.01 of the Credit Agreement are hereby amended and restated in their entirety, and a new definition of "Tier VII" is hereby included in Section 1.01 of the Credit Agreement, in each case to read as follows:
Tier IV means that the senior unsecured debt of the Borrower is rated both (i) BB+ by S&P and (ii) Ba1 by Moodx'x.
Tier IV shall apply for so long as the Company's S&P Senior Debt Rating is BBB- or the Company's D&P Senior Debt Rating is BBB-.

Tier IV. Customers are responsible for creating their own QuickBooks Backup Files *.qbb and cutting and pasting them to their local machine(s) to have their own personal backup/archive of the data. QBB files should be created weekly or monthly or before making major changes to your QBW Company Data File or prior to any major data imports that may affect your data. Copying them to a local pc ensures having a replica in the case of a server outage or inaccessibility.

  • Tier 3 Wire Centers are those Embarq Wire Centers that are not Tier 1 or Tier 2 Wire Centers.

  • Tier 1 means the portion of the design-related information contained in the generic DCD that is approved and certified by this appendix (Tier 1 information). The design descriptions, interface requirements, and site parameters are derived from Tier 2 information. Tier 1 information includes:

  • Tier 1 Support means the Technical Support provided by the Tier 1 Help Desk.

  • Category 2 Training: This category includes services related to training state employees to understand and apply Agile concepts and tools.

  • eligible Categories means Categories (1) through (4) set forth in the table in paragraph 1 of Schedule 1 to this Agreement;

  • Category 3 means a DG facility of greater than 200 kW and not more than 1 MW.

  • eligible Category means Category (1) set forth in the table in paragraph 1 of Schedule 1 to this Agreement;

  • Tier 2 Capital has the meaning given to the term “Tier 2 capital” in 12 C.F.R. Part 217, as amended, modified and supplemented and in effect from time to time or any replacement thereof.

  • Tier means a group of Channels for which a single periodic subscription fee is charged.

  • Number of Students Who Began the Program means the number of students who began a program who were scheduled to complete the program within 100% of the published program length within the reporting calendar year and excludes all students who cancelled during the cancellation period.

  • Eligible Countries means: (a) in the case of the African Development Bank and the Nigeria trust Fund, the Member Countries of the African Development Bank.

  • M3 Target Amount With respect to any Distribution Date, an amount equal to the lesser of (a) the product of (i) 85.50% and (ii) the Pool Balance for such Distribution Date and (b) the amount, if any, by which (i) the Pool Balance for such Distribution Date exceeds (ii) 0.50% of the Cut-off Date Balance.

  • M1 Target Amount With respect to any Distribution Date, an amount equal to the lesser of (a) the product of (i) 70.00% and (ii) the Pool Balance for such Distribution Date and (b) the amount, if any, by which (i) the Pool Balance for such Distribution Date exceeds (ii) 0.50% of the Cut-off Date Balance.

  • Level II means a component of the federal PASRR requirement. Level II refers to the evaluation and determination of whether nursing facility services and specialized services are needed for individuals with mental illness or developmental disability who are potential nursing facility admissions, regardless of the source of payment for the nursing facility service (42 CFR 483.128(a)). Level II evaluations include assessment of the individual’s physical, mental, and functional status (42 CFR 483.132).

  • H1, H2 etc means First Highest, Second Highest Offers etc. in Disposal Tenders means

  • M2 Target Amount With respect to any Distribution Date, an amount equal to the lesser of (a) the product of (i) 81.50% and (ii) the Pool Balance for such Distribution Date and (b) the amount, if any, by which (i) the Pool Balance for such Distribution Date exceeds (ii) 0.50% of the Cut-off Date Balance.

  • Working level month (WLM) means an exposure to 1 working level for 170 hours (2,000 working hours per year divided by 12 months per year is approximately equal to 170 hours per month).

  • Qualifying country component means a component mined, produced, or manufactured in a qualifying country.

  • Targeted Balances Not applicable.

  • M4 Target Amount With respect to any Distribution Date, an amount equal to the lesser of (a) the product of (i) 84.30% and (ii) the Aggregate Pool Balance for such Distribution Date determined as of the last day of the related Collection Period and (b) the amount, if any, by which (i) the Aggregate Pool Balance for such Distribution Date determined as of the last day of the related Collection Period exceeds (ii) the Targeted Overcollateralization Amount.
