Examples of use of the Software in a sentence

  • Your continued access to or use of the Software following HTC’s publication or distribution of modified terms constitutes Your acceptance of such terms.

  • You will comply with all national and international laws, rules and regulations that apply to the Software and Your use of the Software, including the U.S. Export Administration Regulations (to which the Software is subject), as well as end-user, end-use, and destination restrictions issued by U.S. or other governments.

  • The terms of this Agreement govern Your access to and use of the Software.

  • You are an “Enterprise User” if you access the Software on behalf of, or for the benefit of, a third party commercial or government entity (such as your employer), AND such third-party’s use of the Software is subject to the terms of a separate, active software license agreement in place between the third party and HTC directly (“Enterprise Agreement”).

  • If, in the Licensor’s reasonable opinion, the use of the Software and/or App is or may become the subject of an Intellectual Property Claim, then the Licensor shall replace or, with the written consent of the Licensee, modify the Software and/or App which is the subject of the Intellectual Property Claim so they become non-infringing.

  • For clarity, use of the Software as described in Section 13 (RESTRICTED USE) below is expressly excluded from Permitted Uses.

  • The University will not: (a) rent, lease, lend, sell, sublicense, assign, distribute, publish, transfer or otherwise make the Software available to any third party, except as expressly permitted by this Agreement or in the Statement of Work; or (b) use or authorize the use of the Software or Documentation in any manner or for any purpose that is unlawful under applicable Law.

  • Enterprise Users’ access to and use of the Software is governed by the terms of the relevant Enterprise Agreement in lieu of this Agreement.

Related to use of the Software

  • Licensed Software includes error corrections, upgrades, enhancements or new releases, and any deliverables due under a maintenance or service contract (e.g., patches, fixes, PTFs, programs, code or data conversion, or custom programming).

  • Oracle Software means any software agent, application or tool that Oracle makes available to You for download specifically for purposes of facilitating Your access to, operation of, and/or use with, the Services.

  • The Software means the software designed and developed by the Consultant or the Consultant’s Personnel, and includes the source code and object code along with associated documentation, which is the work product of the development efforts envisaged in the Terms of Reference. It does not include commercial off-the-shelf licensed software (except for the customization components of such products).

  • Third Party Software means software which is proprietary to any third party (other than an Affiliate of the Contractor) which is or will be used by the Contractor for the purposes of providing the Services.

  • Software means computer programs, whether in source code or object code form (including any and all software implementation of algorithms, models and methodologies), databases and compilations (including any and all data and collections of data), and all documentation (including user manuals and training materials) related to the foregoing.

  • Custom Software means Software identified as such in Appendix 4 of the Contract Agreement and such other Software as the parties may agree in writing to be Custom Software.

  • Supported Software means the supported software identified in the Proposal. System means the designated information technology environment in which the Software is to be used. Term means the term of this Agreement specified in clause 2.

  • Malicious Software means any software program or code intended to destroy, interfere with, corrupt, or cause undesired effects on program files, data or other information, executable code or application software macros, whether or not its operation is immediate or delayed, and whether the malicious software is introduced wilfully, negligently or without knowledge of its existence.

  • Standard Software means Software identified as such in Appendix 4 of the Contract Agreement and such other Software as the parties may agree in writing to be Standard Software.

  • Customized Software or “Customization” means any Application Software code modified or amended on behalf of the Customer. Setting of parameters, parameterization or configuration is not a Customization.
